Request for Directions Report - 40 and 42 Tuxedo Court - Zoning Amendment Application
On May 28, 2021, a Zoning By-law Amendment application was submitted to permit a mixed-use building with two towers, one 29-storeys and the other 26-storeys, a 667 square metre child care centre and 644 dwelling units at 40 and 42 Tuxedo Court. The existing 15-storey apartment building on-site would be retained. On January 21, 2021, the Applicant has appealed the application to the Ontario Land Tribunal (the "OLT") due to City Council not making a decision within the 90-day time frame in the Planning Act. This report recommends that the City Solicitor with the appropriate City staff attend the OLT hearing to oppose the application in its current form and to continue discussions with the Applicant to resolve outstanding issues.
Scarborough Community Council recommends that: 1. City Council direct the City Solicitor, together with appropriate staff, to attend the Ontario Land Tribunal in opposition to the current application regarding the Zoning By-law Amendment for the lands at 40 and 42 Tuxedo Court and to continue discussions with the Applicant in an attempt to resolve outstanding issues. 2. In the event that the Ontario Land Tribunal allows the appeals in whole or in part, City Council authorize the City Solicitor to request that the Tribunal's Order contain: a. the final form and content of the draft Official Plan and Zoning By-laws to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning; b. the owner has addressed the major outstanding issues raised by Engineering and Construction Services as they relate to the Zoning By-law Amendment application, to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services; c. This report provides information and identifies a preliminary set of issues regarding the Zoning By-law Amendment application to permit the construction of a 12-storey residential building containing 287 residential dwelling units located at 150 Clonmore Drive. The application has been circulated to all appropriate City divisions and public agencies for comment. Construction Staging Area - 2380 to 2382 Kingston Road
As the Toronto Transit Commission (TTC) operates a transit service on Kingston Road, City Council approval of this report is required. 2380 Kingston Road Limited is constructing a six-storey mixed-use rental apartment building with 39 units and ground floor commercial space at 2380 to 2382 Kingston Road. The site is located on the north side of Kingston Road between Sandown Avenue and Sharpe Street. Transportation Services is requesting approval to close the north sidewalk and parking pad, and a portion of the north side westbound curb lane on Kingston Road for a period of six months, from June 16, 2022 to December 16, 2022 to facilitate construction staging operations. Pedestrian operations on the north side of Kingston Road will be maintained in a 2.0 metre-wide covered and protected walkway within the closed portion of the existing lane. Two westbound traffic lanes will be maintained on Kingston Road. At the time that this report was prepared, a decision was pending from City Council on the parking regulation change proposed by Scarborough Community Council on April 25, 2022, to establish new on-street paid parking on the north side of Kingston Road between Midland Avenue and Claremore Avenue. If both the parking regulation change and the construction staging for 2380-2382 Kingston Road are approved by City Council, then the City's Work Zone Construction Coordination Unit will coordinate with Toronto Parking Authority to delay the installation of the parking machines in the vicinity of the development until after construction staging is removed.
Scarborough Community Council recommends that: 1. City Council authorize the closure of the north sidewalk and parking pad, and a 2.7 metre-wide portion of the north side westbound curb lane on Kingston Road, between a point 95.5 metres west of Sandown Avenue and a point 34.9 metres further west and provision of a temporary pedestrian walkway within the closed portion of the westbound curb lane, from June 16, 2022 to December 16, 2022. 2. City Council amend the existing designated accessible loading zone in effect at all times on the west side of Kingston Road, between a point 98 metres south of Sandown Avenue and a point 7 metres further south, to be in effect between a point 61 metres south of Sandown Avenue and a point 7 metres further south. 3. City Council rescind the parking machine regulation in effect from 9:00 a.m. to 9:00 p.m., Monday to Friday, from 8:00 a.m. to 9:00 p.m. Saturday and from 1:00 p.m. to 9:00 p.m. Sunday, at a rate of $2.00 per hour and for a maximum period of three hours on the north side of Kingston Road, between a point 95.5 metres west of Sandown Avenue and a point 34.9 metres further west and between a point 61 metres west of Sandown Avenue and a point 7 metres further west. 4. City Council prohibit stopping at all times on the north side of Kingston Road, between a point 95.5 metres west of Sandown Avenue and a point 34.9 metres further west. 5. City Council direct the applicant to pressure wash or sweep (weather permitting) the construction site and adjacent sidewalks and roadways daily, or more frequently as needed to be cleared of any construction debris and made safe. 6. City Council direct the applicant to construct and maintain a fully covered, protected, unobstructed, and fully Accessibility for Ontarians with Disabilities Act, 2005 compliant walkway for all pedestrians, including for those with mobility devices for the entire duration of the construction staging area permit. 7. City Council direct the applicant to ensure that the existing sidewalks or the proposed pedestrian walkway have proper enhanced lighting to ensure safety and visibility at all times of the day and night. 8. City Council direct the applicant to clearly consult and communicate all construction, parking and road occupancy impacts with local business improvement areas and resident associations in advance of any physical road modifications. 9. City Council direct the applicant to install appropriate signage and request the applicant to install converging mirrors to ensure that pedestrians', cyclists' and motorists' safety is considered at all times. 10. City Council direct the applicant to provide a sufficient number of traffic control persons as determined by the Work Zone Coordinator and Toronto Police Construction Liaison Officer, on a daily basis to control construction vehicle access and egress to and from the site and maintain a safe environment for the public. 11. City Council direct the applicant to provide a sufficient number of pay-duty Police Officers as determined by the Work Zone Coordinator and Toronto Police Construction Liaison Officer, during large scale concrete pours and large scale material deliveries to control vehicle access and egress to and from the site and maintain a safe environment for the public. 12. City Council direct the applicant to install cane detection within the covered and protected walkway to guide pedestrians who are visually impaired. 13. City Council direct the applicant to post a 24-hour monitored construction hotline number on the hoarding board, which must be prominently placed and legible from 20 metres and on all elevations from the construction site. 14. City Council direct the applicant to provide and install public art, including mural artwork, onto every elevation of the hoarding board with adequate spotlighting for night-time illumination, at their sole cost, to the satisfaction of the Ward Councillor. 15. City Council direct the applicant, in consultation with Transportation Services, to maintain any bike lanes, and install appropriate signage to inform drivers and cyclists of any changes to the cycling lanes. 16. City Council direct that Kingston Road be returned to its pre-construction traffic and parking regulations when the project is complete.

Traffic Calming - Janet Boulevard
Speeding and not stopping at the Stop sign has created a dangerous situation on Janet Boulevard. Toronto Police have regularly enforced both offences. Numerous tickets have been issued but speeding and not stopping at the stop sign continue. I am very concerned for the safety of residents specifically children and seniors. I hosted a community consultation meeting, TPS reported that numerous tickets were issued, and residents expressed their concerns relating to community safety. The installation of speed humps is one of the tools to assist with discouraging speeding. Based on the numerous tickets issued and community safety concerns, I am requesting an expedited installation of speed humps on Janet Blvd.

Traffic Control - Treewood Road and Brockley Road
There has been a lot of concern around road safety on Brockley Road, around David and Mary Thomson Collegiate Institute, especially during the school pick-up and drop off times. There are many students that live nearby and walk to school. Their safety is of my utmost concern. Currently there are no traffic controls in place at the T-junction of Treewood Street and Brockley Drive which is causing a lot of disruption on the road. I have had the opportunity to speak with the local residents and the Principal of the school regarding this concern and I am advocating for this all-way compulsory stop control at the intersection of Treewood Street and Brockley Drive.

This staff report is about speed limit reductions for which Community Council has delegated authority to make a final decision, provided that it is not amended so that it varies with City policy or by-laws. The Vision Zero Road Safety Plan Speed Management Strategy focuses on how higher speeds contribute to higher risk of serious injuries and fatalities, and that setting lower speed limits is a key tool for reducing operating speeds on Toronto's roadways. The Vision Zero Speed Management Strategy includes a program for reducing speed limits on local roads, as defined in the City's Road Classification System and public lanes or public alleys, to 30 km/h on a neighbourhood basis. With this approach the City is no longer required to sign every individual street within that designated area but only the entry and exit points to/from the designated area where speed limits change and any internal roads with a different speed limit. The purpose of this report is to recommend area-based speed limit reductions to 30 km/h on public lanes or public alleys and local roads in Scarborough Community Council area as part of the Vision Zero Road Safety Plan Speed Management Strategy.

5 Corporate Drive - Public Art Plan
The purpose of this staff report is to seek City Council approval of the 5 Corporate Drive - Public Art Plan. The Plan, which is included as Attachment 3 of this report, outlines the method by which the owner will commission public art within the privately-owned area of the site. The Public Art Plan provides a framework and description of the commissioning of public art including: project description; history and culture of the area; public art requirement; public art objectives; public art locations; budget; selection process; mentorship opportunity; jury composition and schedule. The attached plan meets the objectives of the City's Percent for Public Art Guidelines and is supported by the Toronto Public Art Commission.
