This report recommends that Item TE8.7 originally adopted on September 16, 2019 be revised to correct omissions to allow for the addition of Ward 14 - Toronto Danforth to the original report and sketch and also to provide for the inclusion of Councillor Fletcher's comments. Ward 14 - Toronto Danforth was inadvertently omitted from the original report due a misinterpretation of the ward boundary as it related to Coxwell Avenue. Going forward, Staff reports for the naming of roads which straddle two ward boundaries will reflect the two adjacent wards. This application proposes to redevelop the site with a mixed-use building containing retail and office uses within the portion fronting 540-544 King Street West and residential uses within the portion fronting 1-7 Morrison Street. Due to the difference in floor-to-ceiling height requirements between office and residential uses, the office portion of the proposed building would be 15-storeys tall and the residential portion would be 17-storeys tall. The overall building height for both portions, including mechanical elements, is proposed at 50 metres. This report reviews and recommends approval of the application to amend the Zoning By-law. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2019). The proposal is consistent with the relevant policies of the Official Plan, the King Spadina Secondary Plan, the Downtown Plan and the King-Spadina Urban Design Guidelines. The proposal provides approximately 18,745 square metres of new office space, maintains a minimum of 10 percent three-bedroom units and 20 percent two-bedroom units, and provides a built form that is compatible with the emerging context of the West Precinct of King-Spadina

Before introducing the necessary Bills to City Council for enactment, require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act as follows: a. Prior to the issuance of the fist above-grade building permit, the owner shall make a cash contribution in the amount of $200,000.00 towards the Toronto Community Housing revolving capital fund for repairs to Toronto Community Housing properties in Ward 10, to the satisfaction of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor. b. Prior to the issuance of the fist above-grade building permit, the owner shall make a cash contribution in the amount of $200,000.00 for the provision of affordable housing in Ward 10 within the vicinity of the site to the satisfaction of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor. c. Prior to the issuance of the fist above-grade building permit, the owner shall make a cash contribution in the amount of $600,000.00 for above base streetscape improvements on the west side of Brant Street between King Street West and Adelaide Street West, including a portion which will be allocated to the revitalization of the playground of the Toronto District School Board property at 20 Brant Street, subject to public access outside of regular school hours, all to the satisfaction of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor. d. All cash contributions referred to in Recommendation 5. a-c above shall be increased upwards by indexing in accordance with the Statistics Canada Construction Price Index for Toronto, calculated from the date of registration of the Section 37 Agreement to the date the payment is made to the City; e. In the event the cash contributions referred to in Recommendation 5.a-d. have not been used for the intended purposes within three (3) years of the By-laws coming into full force and effect, the cash contribution may be redirected for another purpose, at the discretion of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor, provided that the purpose is identified in the Toronto Official Plan and will benefit the community in Ward 10; and f. The following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support development: i. Prior to final site plan approval, the owner shall provide an Interpretation Plan for the subject property at 544 King Street West, to the satisfaction of the Senior Manager, Heritage Planning and thereafter shall implement such Plan to the satisfaction of the Senior Manager, Heritage Planning; ii. Prior to final site plan approval, the owner shall provide a Heritage Lighting Plan that describes how the heritage property will be sensitively illuminated to enhance its heritage character as viewed from the public realm to the satisfaction of the Senior Manager, Heritage Planning; iii. Prior to final site plan approval, the owner shall submit a Signage Plan to the satisfaction of the Senior Manager, Heritage Planning; iv. Prior to the issuance of any Building Permit, the owner shall provide a Letter of Credit, including provision for upwards indexing, in a form and amount and from a bank satisfactory to the Senior Manager, Heritage Planning to secure all work included in the approved Re-construction Plan and approved Interpretation Plan; v. Prior to the issuance of any Building Permit, the owner shall provide full documentation of the existing heritage property at 544 King Street West, including two (2) printed sets of archival quality 8" x 10" colour photographs with borders in a glossy or semi-gloss finish and one (1) digital set on a CD in tiff format and 600 dpi resolution keyed to a location map, elevations and measured drawings, and copies of all existing interior floor plans and original drawings as may be available, to the satisfaction of the Senior Manager, Heritage Planning; vi. Prior to the release of the letter of credit required in Recommendation 5.f.iv. above, the owner shall provide a letter of substantial completion prepared and signed by a qualified heritage consultant confirming that the required restoration work and the required interpretive work has been completed in accordance with the Re-construction Plan and Interpretation Plan and that an appropriate standard of conservation has been maintained, all to the satisfaction of the Senior Manager, Heritage Planning; and vii. The owner agrees to submit, and thereafter implement, a construction management plan to address such matters as noise, dust, street closures, parking and laneway uses and access. Such plan shall be to the satisfaction of the General Manager, Transportation Services and the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor and shall be submitted prior to the commencement of any demolition, shoring or excavation work.

255 Avenue Road - City Initiated Official Plan Amendment - Final Report
This application proposes an Official Plan Amendment for a portion of 255 Avenue Road, a City owned park known as Jay Macpherson Green, to allow for a permanent easement by Enbridge Gas Distribution for the potential relocation of a natural gas district station ("station box") from the Macpherson Avenue right-of-way into the park. An Official Plan Amendment is required because locating the station box in the park requires an easement over lands that are designated as Parks and Open Space Areas in the Official Plan. The establishment of a permanent easement is a form of disposition. The sale or disposal of City owned lands in the Green Space System and Parks and Open Space Areas is prohibited by Official Plan policies. Site and Area Specific Policy No. 265 (SASP No. 265) of the Official Plan identifies certain lands whereby the provisions of the Official Plan prohibiting the disposal of City owned land in the Green Space System and Parks and Open Space Areas do not apply. An Official Plan Amendment would add a portion of 255 Avenue Road to the list of properties in SASP No. 265. The proposed application is consistent with the Provincial Policy Statement (2014) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2019). This report reviews and recommends approval of the application to amend the Official Plan for the purpose stated.

Kensington Market Restaurant and Bar Study - Final Report
At its meeting on February 26, 2019, City Council directed City Planning staff, in consultation with appropriate staff in Municipal Licensing and Standards, Toronto Building, Economic Development and Culture and Legal Services, to conduct an analysis of restaurant and bar uses in Kensington Market and to report back on actions to protect the mix of uses in Kensington Market and control the impacts of restaurant and bar uses. City staff are recommending a multifaceted approach to protecting the retail mix and mitigating the impact of restaurants and bars that includes a planning intervention and a community-based solution. The planning intervention recommends amending the zoning by-laws to limit the size of restaurants and bars in Kensington Market to 100 square metres. The recommended community solution is the establishment of a steering committee comprised of residents, businesses and relevant City staff, that would meet on a regular basis with the aim of improving communication, co-ordination and incident responses. This report also highlights and summarizes concurrent City initiatives and studies that are related to small scale businesses and the impacts of restaurants and bars in Kensington Market. Based on the feedback staff received during the consultation process, and as part of further study for the mix of uses, staff are also recommending that that a separate study be conducted on strategies to regulate chain store retail in Kensington Market.

City Council amend Zoning By-law 438-86, as amended, substantially in accordance with the draft Zoning By-law amendment attached as Attachment 4 to the report (October 15, 2019) from the Director, Community Planning, Toronto and East York District. 2. Within three years of the restaurant size restriction of the attached by-laws coming into force and effect, City Council direct the Director, Community Planning, Toronto and East York District, in collaboration with other relevant divisions, to report back to Toronto and East York Community Council on the effectiveness of the by-laws. 4. City Council support the establishment of a steering committee comprised of residents, businesses, and relevant City staff, including Municipal Licensing and Standards and Toronto Building that would meet regularly to address community concerns regarding the City's by-laws and its enforcement, and to keep an open dialogue between the City and the local community. 5. City Council request the Chief Planner and Executive Director, City Planning to study and analyze strategies to regulate chain store retail in Kensington Market and to report back on his findings Q4, 2020.

This report recommends that City Council refuse an application to demolish a heritage structure on the property at 206 Russell Hill Road, which is subject to Intention to Designate under Part IV, Section 29 of the Ontario Heritage Act. Under the Act, if City Council fails to make a decision on the application within 90 days of issuing a Notice of Receipt of the application, the application is deemed to be permitted under Section 34 of the Ontario Heritage Act. Based on issuance of the Notice of Receipt, the applicant must be notified of Council's decision by December 1, 2019.
