Final Report - 4700 Keele Street - The Quad Phase 2 - Zoning By-law Amendment Application
This application proposes to amend the Zoning By-law to permit two eight (8) storey (25.65 metre high plus mechanical penthouse) private academic accommodations with non-residential uses at grade, located in the south-east quadrant of The Pond Road and Sentinel Road, south of the York University campus. The proposed private academic accommodations would contain approximately 444 residential units and 1,326 square metres of retail comprising 26,997 square metres of total gross floor area at 4700 Keele Street. The proposal is the second phase of a private student housing development known as The Quad, located on the south side of The Pond Road. The proposed development is compatible with its surrounding context. The proposal introduces an appropriate built form to the site with development massed to address the corner of The Pond Road and the extension of Haynes Avenue. The proposed landscaping will provide an improved public realm on The Pond Road, the extension of Haynes Avenue and the extension of Leitch Avenue. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2019). The proposal conforms to the applicable Official Plan policies and complies with the York University Secondary Plan. The proposed development also forms part of the Southwest Precinct Plan Study Area which is currently under review. The Southwest Precinct Plan is envisioned as a medium density urban village with a variety of housing opportunities, shops and services with a neighbourhood square to provide social gathering opportunities and an identity for the precinct. As part of the Precinct Plan, Urban Design Guidelines and supporting strategies are required, including an Affordable Housing Strategy. The Precinct Plan, Urban Guidelines and supporting strategies are currently being finalized. This report reviews and recommends approval of the application to amend the Zoning By-law, with the Bills being held, subject to the finalization of the Southwest Precinct Plan, Urban Design Guidelines and supporting strategies.
Etobicoke York Community Council recommends that: 1. City Council amend former City of North York Zoning By-law No. 7625 for the lands at 4700 Keele Street substantially in accordance with the Revised Draft Zoning By-law Amendment attached as Attachment No. 1 to the report (February 3, 2020) from the Director, Community Planning, Etobicoke York District. 2. City Council authorize the City Solicitor to make such stylistic and technical changes to the Draft Zoning By-law Amendment as may be required. 3. Before introducing the necessary Bill to City Council for enactment, City Council require the owner to provide the final versions of the Southwest Precinct Plan, the accompanying Urban Design Guidelines and the supporting strategies, all to the satisfaction of the Director, Community Planning, Etobicoke York District. 4. Before introducing the necessary Bill to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act to secure the following: a. Prior to the issuance of the first above-grade building permit, a letter of credit shall be submitted, in the City's standard form in the amount of $500,000 to secure for public art on the lands to the satisfaction of the Chief Planner and Executive Director, City Planning Division. The owner shall submit a Public Art Plan that is in accordance with the City's Percent for Public Art Program to the satisfaction of the Chief Planner and Executive Director, City Planning Division and the terms of the Percent for Public Art Program shall be set out in the Section 37 Agreement. b. Prior to the issuance of the first above grade building permit, the owner shall make a cash contribution to the City in the amount of $1,500,000.00 to be used for local park improvements to be determined by the Director, Community Planning, Etobicoke York District in consultation with the Ward Councillor. The financial contribution amount shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto for the period from the date of the registration of the Section 37 Agreement to the date of payment for the local park improvements. c. In the event the cash contribution referred to in Section 4.b. above has not been used for the intended purposes within three (3) years of the By-laws coming into force and effect, the cash contribution may be redirected for another purpose, at the discretion of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor, provided that the purpose is identified in the Toronto Official Plan and will benefit the community in Ward 7. d. The owner shall provide a minimum of 7.4% of the private academic accommodations in Buildings C3 and C4 as affordable rental housing in accordance with the following provisions on terms and conditions to be further set out in the Section 37 Agreement with the City and to the satisfaction of the Chief Planner and Executive Director, City Planning Division: i. The affordable rental housing will comprise a minimum of 7.4% of the private academic bedroom accommodations within a range of residence unit types comprising bachelor, 1, 2, 3 and 4 bedrooms. ii. The owner will maintain the private academic affordable bedroom accommodations in Buildings C3 and C4 as rental housing, and agrees that none of the rental housing will form part of an application for Condominium Registration for at least fifteen years from the date upon which the first new rental housing unit is occupied. iii. Affordable rents will be charged to the tenants who occupy one of the affordable bedroom accommodations for a period of 15 years following the initial occupancy of each of Buildings C3 and C4, providing that the affordable rental bedroom accommodations commence occupancy at the same time, subject to the provisions in 4.d. (iv) and (v). iv. The affordable rents will be based on an average rent level derived from an average rent for comparable existing student residence accommodations on the York University campus for the academic year in which the affordable rental bedroom accommodations will be occupied, adjusted further to reflect differences in lease terms and arrangements for television services in the private academic accommodations, and varied by residence unit type and to reflect single or shared bedroom accommodations. v. After the expiry of the 15 year period, rents charged to tenants newly occupying one of the affordable rental bedroom accommodations will not be subject to restrictions by the City of Toronto under the terms of the Section 37 Agreement entered into under this by-law. vi. Eligibility criteria for students who rent one of the affordable rental bedroom accommodations will require that such student is receiving financial assistance under the Ontario Student Assistance Program. vii. The residence units which contain affordable rental bedroom accommodations shall be furnished and equipped with kitchen and bathroom facilities. e. The following matters are to be secured in the Section 37 Agreement as a legal convenience: i. The applicant shall construct and maintain an area of not less than 740 square metres at grade for use by the general public as publicly accessible open space at the northwest corner of the site in a location generally identified in the Zoning By-law Amendment, on terms and conditions to be set out in the Section 37 Agreement, including maintenance, operations, insurance and indemnity obligations, to the satisfaction of the Chief Planner and Executive Director, City Planning Division, with the specific configuration and design of the public space to be determined and secured through the Site Plan Control application approval process to the satisfaction of the Chief Planner and Executive Director, City Planning Division, in consultation with the Ward Councillor. ii. The applicant shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, Version 3. iii. Prior to issuance of the first above grade building permit for Building C4, the owner shall financially secure all municipal infrastructure and servicing obligations, enter into a subdivision agreement and register the phase of the approved draft plan of subdivision corresponding to Buildings C3 and C4 together with the extension of Leitch Avenue between The Pond Road and Assiniboine Road, to the satisfaction of the Chief Planner and Executive Director, City Planning.

Preliminary Report - 4, 6 and 8 Beamish Drive - Zoning By-law Amendment Application
This report provides information and identifies a preliminary set of issues regarding the application to amend the former City of Etobicoke Zoning Code for the properties located at 4, 6 and 8 Beamish Drive to permit a residential development consisting of a 4-storey podium and a 31-storey tower that would have an overall height of 116 m (inclusive of mechanical equipment). This report provides information and identifies a preliminary set of issues regarding the application to amend the former City of North York Zoning By-law No. 7625 and City-wide Zoning By-law No. 569-2013, for the lands municipally known as 1440 & 1442 Lawrence Avenue West and 2400 Keele Street. The application proposes a 25-storey (88.5 m in height, including the mechanical penthouse) mixed-use building including a 6-storey podium, while retaining the two existing 13-storey rental apartment buildings on the site. The application also proposes a 2-storey (15 m in height, including mechanical penthouse) amenity building for the exclusive use of the residents of the existing rental apartment buildings. The amenity building would have a gross floor area of 882 m2. The proposed 25-storey building would contain 1,571 m2 of non-residential floor area on the first floor and 360 residential rental units above. The proposed building would have a gross floor area of approximately 30,653 m2, while the existing buildings have a combined gross floor area of approximately 83,812 m2. The total gross floor area of all buildings on the site would be 115,347 m2, yielding a Floor Space Index (FSI) of approximately 3.9 times the area of the site. The development would add 330 new net parking spaces proposed at-grade and within a three level below-grade parking garage. Combined with the existing parking, a total of 799 parking spaces are proposed for the site. Vehicular access would be provided via the existing accesses from Wyndale Drive and Lawrence Avenue West. Staff are currently reviewing the application. It has been circulated to all appropriate agencies and City divisions for comment. This report provides information and identifies a preliminary set of issues regarding the application to amend the former City of Etobicoke Zoning Code and City-wide Zoning By-law No. 569-2013 for the properties at 375-385 The West Mall. This application seeks to amend the zoning to permit a mixed use development consisting of a 6-storey podium (21.7 metres in height), a 30-storey tower (94.5 metres in height) and a 14-storey tower (47.3 metres in height). The proposed development would have a total gross floor area of approximately 51,619 m2, including approximately 3,131 m2 of retail uses and 48,488 m2 of residential gross floor area. A total of 665 residential dwelling units are proposed. A total of 763 parking spaces and 4 loading spaces are proposed to service the proposed development. Vehicular access to the site would be provided via driveways from both Civic Centre Court and The West Mall. Staff are currently reviewing the application. This staff report is in regards to a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner of 26 Agar Crescent to maintain a portion of the rear yard fence measured 8.1 metres in length, at a height of 2.28 metres, which does not meet all of the requirements specified in City of Toronto Municipal Code, Chapter 447, Fences.

This staff report is in regards to a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner of 8 Darien Court to maintain a portion of the rear yard fence that ranges in height from 2.0 metres to 2.3 metres, which does not meet all of the requirements specified in City of Toronto Municipal Code, Chapter 447, Fences.

Traffic Calming Poll Results - John Street, between Pine Street and Elm Street

This report summarizes the result of the traffic calming poll for owners and occupants of John Street, between Pine Street and Elm Street. Polling ballots were mailed to the affected residents on October 31, 2019 and 55% of the residents on John Street, between Pine Street and Elm Street responded to the polling and of those 59% were in favour of the installation of speed humps. As a result, the 60% of valid responses supporting the proposal needed to proceed with the installation was not achieved.

Proposed Dogs Off-Leash Area in Bisset Park
Through my community, an urgent need has been identified for a Dogs Off-Leash Area (DOLA) in the Alderwood/Sherway area of Ward 3. In 2019, in partnership with my office, the Alderwood Dog Owners' Association submitted a request for Bisset Park and Alderwood Memorial Park to be considered for a DOLA. A preliminary review of the locations by Parks, Forestry and Recreation identified some issues with these locations. At this time, I believe the location that would best serve both communities is Bisset Park. There is only one home fronting the park, and all other homes are across a municipal road and either back or side onto the park. The other issues can be addressed by reducing the size of the DOLA and potentially reconfiguring the existing pathway. This motion directs Parks, Forestry and Recreation to proceed with planning for a DOLA in Bisset Park.

Status Update for Comprehensive Traffic Study in Mimico
In July 2018, I requested a comprehensive traffic study for the Mimico neighbourhood of the former Ward 6, roughly bounded by Royal York Road to the west, Cavell Avenue to the north, Louise Street to the east, and Lake Shore Blvd West to the south, to assess the appropriateness and feasibility of further speed limit reductions, turning restrictions, vertical deflection traffic calming measures (e.g. speed humps, raised intersections, raised pedestrian crossings), Horizontal deflection traffic calming measures (e.g. chicanes, curb extensions, mid-block pinch-points, traffic islands, traffic circles, raised median islands, curb radius reductions, directional closures to narrow existing one way streets), improved pedestrian crossings and navigation throughout affected area (in conjunction with or complementary to traffic calming measures), and any other measures that may be appropriate in addressing traffic speed, volume, and pedestrian safety. To date I have been provided several different and contradictory updates on the status of this item, as well as who is responsible for completing the study. The motion seeks an update of the status of this item be brought to the next Etobicoke York Community Council meeting, on March 12, 2020.

Speed Limit Amendment - Glenhaven Street (Strathnairn Avenue to Yore Road)
Glenhaven Street is classified in the City's Road Classification System as a local road. This street is located in the residential community east of Keele Street, north of Eglinton Avenue West. The legal speed limit on Glenhaven Street is 50km/h. Sidewalks are present on both sides of Glenhaven Street from Strathnairn Avenue to Lonborough Avenue. A missing section of sidewalk exists on the east side of Glenhaven Street, between Lonborough Avenue and Yore Road. A request has been submitted to Transportation Services to program this missing section of sidewalk for construction. With the adoption of the Vision Zero Road Safety Plan, the speed limits on local roads will eventually be reduced to 30 km/h, with reports from Transportation Services on this initiative to begin in 2021. In light of the concerns raised with my office regarding the speed of vehicles on Glenhaven Street, I believe it is appropriate to proceed with reducing the speed limit to 30 km/h at this time.

Request for Traffic Study in Maple Leaf and Rustic Neighbourhoods
Traffic congestion in the Maple Leaf and Rustic neighbourhoods of Ward 5 has been an ongoing issue. Being within close proximity to both Highways 400 and 401, and with traffic congestion on the surrounding arterial roads Jane Street, Lawrence Avenue West and Keele Street, these neighbourhoods are often used as a cut-through. Over the years, changes have been introduced in an attempt to alleviate traffic and speeding through the area. Examples include the installation of traffic calming, speed limit reductions and the addition of stop signs and turn prohibitions. These measures have not adequately addressed traffic concerns in this area; instead, the issues were redistributed to neighbouring streets. In order to address the traffic concerns in the Maple Leaf and Rustic neighbourhoods, it is important that traffic issues are considered at the neighbourhood level as opposed to considering streets individually. The Toronto Catholic District School Board has begun planning for the future relocation of St. Fidelis Catholic School from 9 Bannerman Street to 155 Falstaff Avenue. It is important that the future relocation of the school is considered in any traffic study of the area so that we can proactively plan for the traffic pattern changes that will inevitably result.

Recently I have learned that a large segment of Rathburn Road, between Martin Grove Road and The East Mall is scheduled for resurfacing. Given the importance of this Minor Arterial, the few alternate routes which may prompt traffic infiltration, and the presence of cycling infrastructure, I am requesting that Transportation Services and Engineering and Construction Services bring forward a report to Community Council to provide additional details.
