1736-1746 Weston Road - Zoning By-law Amendment Application - Appeal Report
On February 7, 2022, a Zoning By-law Amendment application was submitted to permit a 25-storey mixed-use development containing 253 dwelling units and 472 square metres of non-residential floor area. On November 24, 2022, the applicant appealed the application to the Ontario Land Tribunal (OLT) due to Council not making a decision within the prescribed time frame set out in the Planning Act. A Case Management Conference has been scheduled for March 31, 2023. On February 8, 2023, the applicant provided a With Prejudice resubmission of the application to permit a 40-storey mixed-use development containing 446 residential units and 444 square metres of non-residential floor area. This report recommends that the City Solicitor with the appropriate City staff attend the OLT hearing to oppose the application in its current form and to continue discussions with the applicant to resolve outstanding issues.
The Etobicoke York Community Council recommends that: 1. City Council direct the City Solicitor and appropriate staff to attend the Ontario Land Tribunal in opposition to the Zoning By-law Amendment application in its current form for the lands at 1736-1746 Weston Road and to continue discussions with the applicant in an attempt to resolve outstanding issues. 2. In the event that the Ontario Land Tribunal allows the appeal, in whole or in part, City Council authorize the City Solicitor to request that the Ontario Land Tribunal withhold the issuance of a final Order until such time as the Ontario Land Tribunal has been advised by the City Solicitor that: a.The owner has submitted a revised Transportation Impact Study including all requested revisions to the satisfaction of the General Manager of Transportation Services; b.The owner has submitted a revised Functional Servicing Report to determine the stormwater runoff, sanitary flow and water supply demand resulting from this development and whether there is adequate capacity in the existing municipal infrastructure to accommodate the proposed development, to the satisfaction of the Chief Engineer and Executive Director of Engineering and Construction Services; c. The Noise and Vibration Report has been peer reviewed at the cost of the applicant and the report has been revised to the satisfaction of the Chief Planner and Director, City Planning; d. The owner has provided a revised Pedestrian Wind Study, such report to be reviewed with recommendations implemented as part of the amending Zoning By-law(s) and/or secured in a development agreement, to the satisfaction of the Chief Planner and Executive Director, City Planning; and e. The form and content of Zoning By-law Amendment is satisfactory to the Chief Planner and Executive Director, City Planning and the City Solicitor. 3. Should it be determined that upgrades are required to the infrastructure to support the development according to the accepted Functional Servicing Report and/or the Transportation Impact Study, City Council direct the City Solicitor and appropriate City staff to request that a Holding Provision be included in the final form of the site-specific Zoning By-law Amendment, not to be lifted until such time as the owner has made satisfactory arrangements, including entering into appropriate agreement(s) with the City for the design and construction of any improvements to the municipal infrastructure and the provision of financial securities to the satisfaction of the Chief Engineer and Executive Director of Engineering and Construction Services and General Manager of Transportation Services. 4. City Council authorize the City Solicitor and other City staff to take any necessary steps to implement City Council's decision.

On August 31, 2021, a Zoning By-law Amendment application was submitted by Dunpar Homes to permit a 15-storey residential building at 4174 Dundas Street West. A total of 117 units are proposed with a gross floor area of 13,194 square metres and a density of 6.4 times the area of the lot. On December 23, 2021, the applicant appealed the rezoning application to the Ontario Land Tribunal (OLT) due to City Council not making a decision on the application within the prescribed timeframe of the Planning Act. A Case Management Conference was held on February 6, 2023 and a hearing is scheduled for 14 days commencing on February 12, 2024. On July 22, 2022, the applicant submitted an Official Plan Amendment application in support of the proposal. This application was appealed on November 21, 2022 and a second Case Management Conference is scheduled for July 5, 2023. Both appeals have been consolidated at the OLT. This report recommends that City Council direct the City Solicitor, together with appropriate City staff, to attend the OLT hearing in opposition to the application in its current form and to continue discussions with the applicant to resolve outstanding issues.

The owner has provided a revised Arborist Report, Tree Inventory and Preservation Plan, Landscape Plan, to the satisfaction of the Supervisor, Tree Protection and Plan Review; g. The owner has addressed all outstanding issues raised by Urban Forestry, Ravine and Natural Feature Protection as they relate to the Official Plan Amendment and Zoning By-law Amendment applications, to the satisfaction of the Manager, Ravine and Natural Feature Protection; h. The owner has satisfied the requirements of the Toronto and Region Conservation Authority regarding requested revisions to reports, and policy and/or zoning revisions requested to address the long-term stable top-of-slope issue; and i. The owner has satisfied the requirements of the Toronto District School Board and the Toronto Catholic District School Board regarding signage and warning clauses; 3. City Council request staff schedule a Community Information Meeting for the application together with the Ward Councillor and with the participation of the applicant. 4. 25 Foxwell Street - Request for a Fence Exemption to the Toronto Municipal Code, Chapter 447
This staff report concerns a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Community Council concerning an application by the property owner of 25 Foxwell Street for a site-specific Fence Exemption, pursuant to Section 447-1.5(B) of Toronto Municipal Code, Chapter 447- Fences. The property owner is seeking Community Council's permission to add 1 additional 8 feet (2.4 metres) high panel and 6 feet in width for privacy from anyone going up/down the fire escape from looking into the back yard. He is also seeking permission to keep the existing 2 metres high fence so they can be side by side at the same height, a Notice was issued for the existing fence that is in excess of 2 metres.
The Etobicoke York Community Council: 1. Granted the application for a fence exemption permit (with or without conditions) to the property owners of 25 Foxwell Street, thereby allowing the proposed fence to be installed. This staff report is in regards to a matter for which the Etobicoke Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Council concerning an application by the property owner of 62 Edenvale Crescent for a site-specific Fence Exemption, pursuant to Section 447-1.2.A(3) of Toronto Municipal Code, Chapter 447, Fences. The property owner is seeking Council's permission to allow for the existing vinyl fence, which does not comply with the standards stipulated by Section 1.3 E 2(b) of the by-law.
The Etobicoke York Community Council: 1. Granted the application for a fence exemption by the property owner of 62 Edenvale Crescent, thereby allowing the erected fence to be maintained as constructed. At such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law. 2. As a condition of approval, required that the property owner periodically inspect the fence and maintain it in good repair in a stable, upright and integral condition, and that it be free from broken or stretched parts or loose elements which may be easily removed or would facilitate climbing.

The purpose of this report is to advise Council concerning an application by the property owner of 78 Paulart Drive for a site-specific Fence Exemption, pursuant to Section 447-1.3.E(2)(C) of Toronto Municipal Code, Chapter 447, Fences. The property owner is seeking Council's permission to allow for an aluminum and composite fencing, which do not comply with the standards stipulated by Section 447-1.3.E(2)(C) of the by-law.

119 Westrose Avenue - Encroachment Appeal
This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision. Transportation Services has reviewed an application to construct a fence encroachment within the public right-of-way at 119 Westrose Avenue. The encroachment consists of a wood board fence which is in contravention of the City of Toronto Municipal Code Chapter 743, Streets and Sidewalks, Use Of. Specifically, the fence does not comply because it is within 70 metres of an intersection and exceeds one (1) metre in height. Although the fence is in contravention of the requirements under the Toronto Municipal Code Chapter 743, staff is of the opinion that it will not have a negative impact on the public right-of-way for pedestrians or for traffic on the affected streets. Therefore, Transportation Services is requesting authority to enter into an encroachment agreement with the property owner, subject to conditions.
The Etobicoke York Community Council: 1. Authorized the General Manager of Transportation Services to enter into an encroachment agreement with the property owner of 119 Westrose Avenue, to permit a fence encroachment, subject to the following conditions: a. Indemnify the City from and against all actions, suits, claims or demands and from all loss, costs, damages, and expenses that may result from such permission granted; b. Maintain the fence at their own expense in good repair and a condition satisfactory to the General Manager of Transportation Services and will not make any additions or modifications to the encroachment beyond what is allowed under the terms of the Agreement. c. Accept such additional conditions as the City Solicitor or the General Manager of Transportation Services may deem necessary in the interest of the City; d. Remove the fence encroachment upon receiving written notice to do so; and e. The property owner will enter into an encroachment agreement with the City of Toronto, at the applicant's expense, and assume all liability and damages related to the encroachments.

400 Rockcliffe Boulevard - Pedestrian Crossing Protection
As the Toronto Transit Commission (TTC) operates a transit service on Rockcliffe Boulevard, City Council approval of this report is required. Transportation Services has reviewed the need for pedestrian crossing protection at 400 Rockcliffe Boulevard (fronting Rockcliffe Middle School). Based on the assessment undertaken, Transportation Services does not recommend the installation of pedestrian crossing protection at 400 Rockcliffe Boulevard as the warrant criteria was not met for a pedestrian crossover (PXO).
The Etobicoke York Community Council recommends that: 1. City Council authorize the installation of a pedestrian crossover (PXO) on Rockcliffe Boulevard approximately 35m south of Rockcliffe Court.

John Best Avenue - Traffic Calming
This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision. Transportation Services has reviewed the need for traffic calming (speed humps) on John Best Avenue, between Sam Frustaglio Drive and Jane Street. The assessment indicates the warrant criteria as set out in the City of Toronto's Traffic Calming Policy has not been satisfied. Therefore, staff do not recommend the installation of speed humps on John Best Avenue.

My office have received numerous calls from residents advising of the dangerous situation at making a left turn onto Abraham Welsh Rd while travelling Westbound on Sheppard Ave W. Residents have advised of long wait times to turn left thus creating conditions where cars are rushing to make the turn and putting pedestrians at risk. To ensure the safety of the community, I recommend implementing a Westbound Left Turn Signal during the morning and afternoon rush period at this location.

Snow plow damage to sod along sidewalks and other landscape features within the road right of way
Following the recent winter snow melt, my office has received numerous calls with concerns over snow plow damage to sod along sidewalks and other landscape features within the road right of way. A review of information from 311 Toronto shows that there have been hundreds of calls for damage within this district, and based on observation, they likely represent a fraction of the damage. While there are a number of contributing factors, the extent of the plow damage is clearly more than in recent prior years, both in the number of incidents, and also in severity with numerous very deep and very large gouges to grassed areas. A large amount of debris and soil has been deposited along sidewalks, at bus stops, and at the edges of the road. I am writing to request an update be provided to the Etobicoke York Community Council at the May 15, 2023 Community Council meeting concerning the extent of damage, the plan to make repairs, an overview of the responsibilities of the City, the snow clearing contractor, and of residents, and on progress toward making repairs this spring. A brief report would be helpful to inform members of Council and residents about the way forward to restore the City's right of way back to a state of good repair.
