Application to Remove a Private Tree - 34 Whittaker Crescent
This report requests that City Council deny the request for a permit to remove one privately owned tree located at 34 Whittaker Crescent. The application indicates the reasons for removal are to address concerns that the tree is overhanging the dwelling, property, and neighbouring driveway. The subject tree is a Norway spruce (Picea abies), measuring 51 cm in diameter. The Private Tree By-law does not support the removal of the tree as it is healthy and maintainable.

4588 Bathurst Street Electronic Ground Street Sign Application
The property owner of Sherman Campus, a recreational, educational and social Jewish Community Centre at 4588 Bathurst Street is proposing to install and maintain an electronic ground sign at the southern corner of the driveway entrance of the property on the west side of Bathurst Street.. The proposed sign will be constructed of aluminum angular frames and vinyl overlay measuring 0.51 metre in thickness, 3.43 metres in width, and 6.02 metres in height above ground and 2.44 metres depth, located in the City's right of way. Transportation Services requires North York Community Council's authority to permit the installation of the above mentioned ground sign and enter into an encroachment agreement with the property owner based on the submitted plans and applicable By-laws. The proposed electronic ground sign on the public right of way does not meet the requirements of the City of Toronto Municipal Code, Chapter 743, Streets and Sidewalks, Use of, for delegated approval as an encroachment by the General Manager, Transportation Services. Notwithstanding, Transportation Services does not have any objections to the proposed sign.
North York Community Council: 1. Authorized Transportation Services to permit the installation of the proposed ground sign and enter into an encroachment agreement with the property owner in accordance with Article III - Street Work of Municipal Code Chapter 743 - Streets and Sidewalks, Use of, with the following conditions: a. applicant/contractor to ensure that electrical wirings and connections from subject sign to source in the building be in accordance with Ontario Electrical Safety Code; b. applicant/contractor shall check and comply with the minimum clearance between the nearest sign boundary to any electrical conductor above it as per Ontario Building Code; and c. a report confirming compliance to Items a) and b) above signed by a qualified person shall be submitted to Transportation Services after the installation of said ground sign.

13 Barberry Place - Residential Demolition Application
On June 11th, 2020, Toronto Building received a request from Transportation Services to demolish an existing single family dwelling at 13 Barberry Place. Transportation Services requests the demolition of 13 Barberry Place, a two-storey, single family detached dwellings located south of Sheppard Ave E and east of Bayview Ave. This property was acquired by the City in 2018 as part of the planned construction of the Council-endorsed "Thomas Clark Way", a planned street in North York connecting Rean Drive to Kenaston Gardens. Furthermore, my office has been informed of a rodent issue at 13 Barberry Place. It is a property that the City expropriated for the future extension of Thomas Clark Way but it has since fallen into disrepair and is now the site of a rat infestation. The building is neither listed nor designated under the Ontario Heritage Act. Heritage Preservation Services have also confirmed that the property is not on any potential list. The demolition application is being referred to the North York Community Council because the building proposed to be demolished at 13 Barberry Place is residential and the applicant has not received a permit to replace the building or to redevelop the site. In such a case, Chapter 363 Article II of the City of Toronto Municipal Code requires Community Council to issue or refuse the demolition permit.
North York Community Council: 1. Approved the application to demolish the single family dwellings at 13 Barberry Place with the following conditions: a. that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official; b. that all debris and rubble be removed immediately after demolition; c. that sod be laid on the site and be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5, and 629-10, paragraph B; and d. that any holes on the property are backfilled with clean fill.
