This report recommends that City Council deny the request for a permit to remove one (1) privately-owned tree located on the boundary line between the properties at 160 and 168 Erskine Avenue. The owner at 168 Erskine Avenue is requesting removal to address concerns regarding the tree roots' impact on the adjacent driveway and the structural shape of the crown. The subject tree is an American elm (Ulmus americana) measuring 62 cm in diameter. Urban Forestry does not support removal of this tree as it is healthy and maintainable.

Application to Remove a City Tree - 82 Cameron Avenue
This report recommends that City Council deny the application for a permit to remove one (1) City-owned tree located at 82 Cameron Avenue. Removal has been requested to address concerns that the tree is not healthy and in conflict with a proposed driveway to provide access to an existing integral garage. The subject tree is a silver maple (Acer saccharinum) tree measuring 124 cm in diameter. Urban Forestry does not support removal of this tree as it is healthy and maintainable.

Front Yard Parking Appeal - 19 Le May Road
This staff report is about a matter which Community Council has delegated authority from City Council to make a final decision. Transportation Services has assessed an appeal from the owner of 19 Le May Road for front yard parking. Front yard parking at this location is not recommended because it does not meet the requirements of the City of Toronto Municipal Code Chapter 918 in that the Code does not permit the licensing of a front yard parking pad where on street permit parking is authorized on the same side of the street. The owner will be given an opportunity to make a deputation before Community Council.

Request for Fence Exemption - Rear Yard - 21 Armour Blvd
This staff report is in regards to a matter for which the North York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner of 21 Armour Blvd for a site-specific Fence Exemption to maintain an existing rear yard fence which does not comply with restrictions specified in the City of Toronto Municipal Code, Chapter 447, Fences. The subject property 21 Armour Blvd is located in Ward 16, on a residential zone property.
North York Community Council: 1. Refused to grant the application for an exemption permit, by the owner(s) of 21 Armour Boulevard, for a 2.22m average high fence in the rear yard, for failing to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences.

Municipal Licensing & Standards recommends that the North York Community Council give consideration to the exemption application and decide to: 1. Refuse to grant the application for an exemption permit by the owner(s) of 21 Armour Boulevard, for a 2.22m average high fence in the rear yard, for failing to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences. Or, 2. Grant the application for the existing wood board on board fence, rear yard, between numbers 21 and 23 Armour Boulevard, measuring an average of 2.22m, without conditions. Direct and require that the installation be maintained in good repair without alteration. Direct and require that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

Speed Limit Reduction on Fenn Avenue
A number of residents on Fenn Avenue have contacted me to share their concerns about speed and volume issues on their street. Residents regularly observe motorists turning southbound onto Fenn Avenue from York Mills Road to avoid congestion at the intersection of Bayview Avenue and York Mills Road. These drivers are often travelling at high speeds in an attempt to make-up time after re-routing from York Mills Road. Fenn Avenue is a residential street with many families and children walking to and from the nearby Owen Park and Owen Public School.
North York Community Council: 1. Reduced the speed limit from 50km/h to 40km/h on Fenn Avenue, between York Mills Road and the south end of Fenn Avenue.

Parking Restriction on Bainbridge Avenue
At its meeting held on July 4, 2018, North York Community Council rescinded the parking prohibition in effect from 7:00 a.m. to 6:00 p.m., Monday to Friday, on the north side of Bainbridge Avenue, from Bathurst Street to a point 133 metres west (NY32.52). Local residents thought the parking prohibition was too strict and requested that parking be permitted for the statutory maximum period of three hours on that portion of the street. However, since the changes were signed on-street, residents have requested that the 7:00 a.m. to 6:00 p.m., Monday to Friday, parking prohibition be reinstated on the north side of Bainbridge Avenue, between a point 113 metres west of Bathurst Street and a point 133 metres west of Bathurst Street.

On November 8, 2018, the Committee of Adjustment (the "Committee") heard a minor variance application related to the property municipally known as 777 Wilson Heights Boulevard. The owner of 777 Wilson Heights Boulevard (the "Applicant") sought to construct a second-storey addition to the existing single-detached dwelling that required minor variances to maintain the existing dwelling, covered patio, existing one-storey walk out enclosure, and structures, as constructed (the "Application"). The Applicant originally received approval from the Committee in 2017 to construct a second-storey addition in which the Applicant proposed to remove the existing rear patio platform and one-storey walk out enclosure. The 2018 Application proposed to maintain the existing rear platform and enclosure. In a report prepared for the Committee from the Director of Community Planning, North York District dated October 30, 2018, Planning Staff recommended that the Application: (1) be deferred; or (2) refused, if the Committee did not grant a deferral ("Report"). The Report indicated that the Application was pre-mature because a revised zoning notice issued by Toronto Building clarified the variances ("revised zoning notice") that the Applicant would have to satisfy in its Application. The Committee based its Decision on an Application that did not address the revised zoning notice. The Committee refused the Application ("Decision"). On November 26, 2018, the Applicant appealed the Committee's Decision to the Toronto Local Appeal Body ("TLAB").
North York Community Council recommends that: 1. City Council authorize the City Solicitor, along with appropriate City Staff, and outside consultants, as necessary, to attend the Toronto Local Appeal Body in order to oppose the Application and related variances requested in Application No. A0431/18NY respecting 777 Wilson Heights Boulevard. 2. City Council authorize the City Solicitor to attempt to negotiate a resolution of the appeal of the Committee of Adjustment's decision (Application No. A0431/18NY) respecting 777 Wilson Heights Boulevard, and the City Solicitor be authorized to resolve the matter on behalf of the City in her discretion after consulting with the Ward Councillor and with the Director of Community Planning, North York District.

Representation at the Toronto Local Appeal Body for 37 Stafford Road
The Applicant has applied to the Committee of Adjustment (Application Nos. B0044/18NY, A0663/18NY, A0664/18NY) to obtain consent to sever the property at 37 Stafford Road into two undersized residential lots and for minor variances from Zoning By-laws 7625 and 569-2013 to permit the construction of a new two-storey dwellings on each of the proposed severed lots (the "Applications"). City Planning submitted a staff report to the Committee of Adjustment regarding the Application dated December 21, 2017 (the "Staff Report"). In the Staff Report, City Planning recommended that the Committee refuse the consent and minor variances as the applications fail to satisfy Section 5 1(24) and Section 45(1) of the Planning Act. At its hearing on December 6, 2018, the Committee of Adjustment approved the applications for both the consent and minor variances. A similar application for consent and minor variances was previously heard and refused by the Committee on January 11, 2018. Copies of the Notices of Decision and Staff Report are attached. In order to preserve the City's right of appeal, the City Solicitor has already appealed the Committee's Decision to the Toronto Local Appeal Body (the "TLAB"). This motion will give the City Solicitor retroactive authority to appeal the Decision to the TLAB. This motion will also authorize the City Solicitor, and appropriate City Staff, to attend the TLAB in order to oppose the proposed variances requested in the Application. This motion will also give the City Solicitor authority to negotiate a settlement of the appeal and retain outside consultants as necessary. This matter is time sensitive and urgent as the City Solicitor has already appealed the Decision to the Toronto Local Appeal Body in order to preserve the City's statutory right and requires instructions to appeal and attend the hearing for this matter.

The Applicant has applied to the Committee of Adjustment (Application No. A0760/18NY) for variances to the applicable zoning by-laws to permit the construction of a new detached dwelling (the "Application") at 122 Elmwood Avenue. The proposed variances relate to building height, building depth, building length, lot coverage, exterior stairs, rear platform area, east side yard setback, and west side yard setback. City Planning submitted a staff report to the Committee of Adjustment regarding the Application dated November 27, 2018 (the "Staff Report"). In the Staff Report, City Planning expressed concerns with the variances related to east and west side yard setbacks, additional building height, lot coverage. At its hearing on December 6, 2018, the Committee of Adjustment approved the Application (the "Decision"). A copy of the Notice of Decision of the Committee of Adjustment and the Staff Report are attached. In order to preserve the City's right of appeal, the City Solicitor appealed the Committee's Decision to the Toronto Local Appeal Body (the "TLAB") on December 21, 2018. This motion will give the City Solicitor retroactive authority to appeal the Decision to the TLAB. The Applicant has applied to the Committee of Adjustment (Application Nos. B0017/18NY, B0018/18NY, A0238/18NY, A0239/18NY & A0398/18NY) to obtain consent to sever the rear portion of the properties at 223 and 225 Northwood Drive into three undersized residential lots and for minor variances from Zoning By-laws 7625 and 569-2013 to permit the construction of a new two-storey dwellings on two of the severed lots and to legalize a newly built dwelling on one of the lots (the "Applications"). At its hearing on October 11th, 2018, the Committee of Adjustment refused the applications for both the consent and minor variances. Copies of the Notices of Decision are attached. This motion will authorize the City Solicitor, and appropriate City Staff, to attend the TLAB in order to oppose the proposed consent and variances requested in the Application. This motion will also give the City Solicitor authority to negotiate a settlement of the appeal and retain outside consultants as necessary. This matter is time sensitive and urgent as the Applicant has already appealed the Decision to the Toronto Local Appeal Body and staff require further instructions to attend the hearing for this matter.
