Toronto Parking Authority - 2019 Results of Follow-up of Previous Audit Recommendations
On an annual basis, the Auditor General reviews the implementation status of outstanding audit recommendations and reports the review results to City Council through the City's Audit Committee. This report provides the implementation status of recommendations contained in the following four audit reports issued to the Toronto Parking Authority (TPA): - Toronto Parking Authority Phase 1: Audit of Real Estate Activities, 2015; - Toronto Parking Authority Phase 2: Audit of the Revenue Operations of Off-Street Controlled Facilities, 2016; - Auditor General's Observations of a Land Acquisition at Finch Avenue West and Arrow Road by the Toronto Parking Authority, 2016; and - Auditor General's Observations of a Land Acquisition at Finch Avenue West and Arrow Road by the Toronto Parking Authority - Part 2, 2017. As of December 31, 2017, there were 30 outstanding recommendations from audit and investigation reports issued to the TPA between 2015 and 2017. Thirteen recommendations arise from the Auditor General's 2015 audit of real estate activities. Although the recommendations are still relevant, as a result of the adoption of the City-wide real estate model, the TPA no longer carries out real estate transactions on an independent basis. The TPA, CreateTO, and City Real Estate Services continue to work together to evolve the processes for acquiring, selling, and/or developing the TPA's lands. Given the extent of changes being made to the TPA's real estate operations, the Auditor General would need to conduct an entirely new audit to be able to have a reasonable basis to form conclusions to confirm that the recommendations have been implemented. Therefore, the Auditor General has decided that the 13 audit recommendations will no longer be included in her annual follow-up process. After all process changes have been completed, the Auditor General will consider whether to include a new audit in her future audit work plans. Again, these recommendations remain relevant and should be considered by the TPA, CreateTO, and City Real Estate Services as they continue to work together to implement the City-wide real estate model. Of the remaining 17 outstanding recommendations, our review verified that eight recommendations have been fully implemented, seven recommendations have been partially implemented, and two are no longer applicable. We express our appreciation for the co-operation and assistance we received from management and staff during this year's follow-up review process.

Construction of Municipal Car Park 673, 2204-2212 Eglinton Avenue West - Contract Award
Design drawings and a tender package for the project were prepared by Marton & Smith Landscape Architects (MSLA) to include all technical requirements, material, and labour for the construction of Municipal Car Park 673. MSLA tendered the work to eight pre-qualified general contractors on May 3, 2019. The tender call closed on May 22, 2019 and seven bids were received and considered as listed below in the ascending order without the HST. The Acting President, Toronto Parking Authority recommends that: 1. The Board of Directors of the Toronto Parking Authority grant authority to award the contract for the construction of Municipal Car Park 673, located at 2204-2212 Eglinton Avenue West, to Bevcon Construction & Paving Ltd., having submitted the lowest compliant bid and meeting all specifications in conformance with the tender requirements, in the amount of $820,200 plus $29,800 as a contingency allowance, being the sum total amount of $850,000 net of all taxes and charges.

Modifications to Operations, Municipal Car Park 58, 9 Bedford Road - Construction Contract Award
A tender package, including all technical requirements, material, and labour, was prepared by McIntosh Perry Limited as previously approved by the TPA (Internal Memorandum, November 7, 2017). McIntosh Perry Limited tendered the work on behalf of the TPA to 11 pre-qualified general contractors on May 1, 2019. The call closed on May 22, 2019 and four bids were received and considered as listed below in the ascending order without the HST. The Board of Directors of the Toronto Parking Authority grant authority to award the construction contract for the modifications to operations at Municipal Car Park 58, located at 9 Bedford Road, to Alto Restoration Inc., having submitted the lowest compliant bid and meeting all specifications in conformance with the tender requirements, in the amount of $555,200 plus $54,800 as a contingency allowance, being the sum total amount of $610,000 net of all taxes and charges.

A tender package, including all technical requirements, material, and labour for the electrical switchboard upgrades, was prepared by AECOM, as previously approved by Purchase Order Numbers 37520 and 38014. AECOM tendered the work on behalf of the TPA to six pre-qualified general contractors in March 2019. The call closed on April 26, 2019 and two bids were received and considered as listed below in the ascending order (amounts shown not including HST). The Board of Directors of the Toronto Parking Authority grant authority to award the construction contract for the electrical switchboard upgrades for Municipal Car Parks 29 (75 Holly Street) and 43 (C1) (2 Church Street) to Beckett Electrical Inc., having submitted the lowest bid and meeting all specifications in conformance with the construction tender requirements, in the amount of $363,500 plus $16,500 as a contingency allowance, being the sum total amount of $380,000 net of all taxes and charges.

Toronto Parking Authority - Status Update 2: Security Services Assessment and Transition
The Board of Directors of the Toronto Parking Authority (TPA) considered Item PA15.6, Toronto Parking Authority - Status Update of Security Services Assessment, at its October 24, 2018 meeting. The Item set out the preliminary results of an assessment of the TPA's security strategies, plans, and deployment conducted by the City of Toronto's Director of Corporate Security. The Board adopted a comprehensive framework comprising a range of recommendations and initial actions to further the goals of augmenting, enhancing, and updating the TPA's security program. Among other things, the Board directed that steps be initiated leading to the City's Corporate Security Division assuming direct management of the TPA's security program. TPA staff have worked in close collaboration with the City's Corporate Security Division to develop the key parameters of a Service Level Agreement, which are set out in this report and will achieve the Board's direction. This report also presents a Security Policy and Plan for the Toronto Parking Authority, in conformance with City Council's previous direction that various City Boards and Agencies report to their respective Boards regarding their security plan, consistent with the security framework adopted by City Council. Finally, the matter of a billing dispute with a previous service provider which was detailed to the Board at its above-noted meeting has been closed and no further payments were or will be made.

The Acting President, Toronto Parking Authority recommends that: 1. The Board of Directors of the Toronto Parking Authority approve Toronto Parking Authority Policy Resolution 7-3: Security Policy and Plan, outlined in Attachment 1 to the report (May 31, 2019) from the Acting President, Toronto Parking Authority, and direct the Acting President to incorporate any further amendments that may arise from the Board's approval and enact the Policy Resolution. 2. The Board of Directors of the Toronto Parking Authority direct the Acting President, Toronto Parking Authority, to formally engage the City of Toronto's Corporate Security Division for the purpose of assuming management and oversight responsibility of the Toronto Parking Authority's security program. 3. The Board of Directors of the Toronto Parking Authority authorize the Acting President, Toronto Parking Authority, to enter into a Service Level Agreement (SLA) with the City of Toronto's Corporate Security Division for the management and oversight responsibility of the Toronto Parking Authority's security program, generally incorporating the parameters outlined in Table 1 to the report (May 31, 2019) from the Acting President, Toronto Parking Authority, subject to further refinement, amendment, and/or additional terms and conditions as may be acceptable to the Acting President.

The Toronto Parking Authority's (TPA) current accounting system is a custom-built application initially developed and implemented in the mid-1980s. The system has significant limitations and is approaching a state of obsolescence. Accordingly, the TPA initiated a comprehensive market scan, through a formal open Request for Information process, with the goal of ultimately procuring and implementing a modernized Enterprise Resource Planning and Reporting (ERP) Solution. Based on the results of the evaluation process, this report recommends that the TPA Board of Directors approve entering into a non-competitive contract with SAP Canada to provide software licensing and professional services, by leveraging the terms and conditions of the City of Toronto's Master Services Agreement with SAP Canada, for the delivery of a non-customized, single tenant cloud-based software-as-a-service ERP to support the TPA's financial and operational growth and transformation with a fully-hosted, robust, standardized, and scalable platform. SAP S/4HANA Cloud, single tenant edition, is an ERP software package which operates on a fully-integrated cloud platform providing SAP S/4HANA Finance, SAP Analytics Cloud, SAP Asset Manager (Mobility), Customer Relationship Management (CRM), and SAP Success Factors applications. Implementation of SAP's "model company" will provide effective, efficient administration to support finance and daily operations, including procurement, contract management, work orders, and asset management. A cost-benefit analysis for the ERP was undertaken in support of the recommended approach. By using the City of Toronto's Master Services Agreement, the TPA estimates annual license fee savings of approximately $120,000 and a projected investment break-even at 6.5 years based upon the current project plan.

The Board of Directors of the Toronto Parking Authority authorize the Acting President, Toronto Parking Authority, to negotiate and enter into a non-competitive agreement with SAP Canada for the provision of SAP S/4HANA Enterprise Resource Planning and Reporting Solution software licensing and related professional services for a five-year term in the amount of $4,645,223 plus Harmonized Sales Tax, on terms and conditions satisfactory to the Acting President and in a form satisfactory to the City Solicitor.
