Request for Fence Exemption - Front Yard 70 Falaise Road
This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Council concerning an application by the owner(s) of 70 Falaise Road for a site-specific Fence Exemption, pursuant to Section 447-1.5 of Toronto Municipal Code, Chapter 447- Fences. The property owners are seeking Council's permission to be exempt concerning a proposed wrought iron fence to be located in the front of the property, which does not comply with restrictions contrary to Section 447- Section 447-1.2. B. (1) of the bylaw as detailed below in the following chart: The subject property on the west side of Falaise Road, is a corner lot, with a two story detached residential dwelling. It is located in Ward 24, in a Residential Zoned Area, north of Kingston Road and west of Morningside Avenue. Municipal Licensing and Standards recommends that the Scarborough Community Council: 1. Refuse to grant the application for an exemption permit, by the owners of 70 Falaise Road, for a proposed fence that fails to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences. OR 2. Grant the application for the proposed fence thereby to be constructed. Direct and require that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

This staff report is in regards to a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner(s) of 28 Keon Place for a site-specific Fence Exemption, pursuant to the Toronto Municipal Code, Chapter 447- Fences. The property owner(s) is seeking Council's permission to be exempt from Chapter 447 - 1.2.C - Open-fence construction required and Chapter 447 -1.2 (B)(1) fence in front yard and within 2.4 m of a lot line abutting a public highway maximum height of 1.2m. The subject property 28 Keon Place is located in Ward 25, on a residentially zoned property. GENERAL LOCATION SPECIFIC LOCATION EXISTING CONSTRUCTION & DEFICIENCY BY-LAW SECTION & REQUIREMENT Front Yard Front yard- West side Existing fence within 2.4 metres of the driveway of number 28 Keon Place as well as the adjacent neighbour located at 26 Keon Place, is not of open mesh chain-link fence or of an equivalent open-fence construction for at least 2.4 metres from the lot line at which the driveway begins so as not to obstruct the view of the boulevard or highway. Municipal Licensing and Standards recommends that the Scarborough Community Council give consideration to the exemption application and decide to: 1. Refuse to grant the application for an exemption by the owners of 28 Keon Place, for the existing board on board wood fence which does not comply with the provisions of Toronto Municipal Code, Chapter 447, Fences, and direct that a Notice of Violation be issued. OR 2. Grant the application for the proposed exemption. Direct and require that the installation be maintained in good repair without alteration. Direct and require that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

Intention to Designate Under Part IV, Section 29 of the Ontario Heritage Act - 3315 Midland Avenue
This report recommends that City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act. The subject property is located on the east side of Midland Avenue at the north-east corner with South Shields Avenue in the Agincourt neighbourhood and contains a one-and-a-half storey house dating to c. 1875. In 2006, City Council listed the property at 3315 Midland Avenue, containing a house historically known as the George L'Amoreaux farm house (c.1875), on the City of Toronto's Inventory of Heritage Properties (now known as the Heritage Register). The property has been identified as having archaeological potential in accordance with the City of Toronto's Archaeological Master Plan. Following research and evaluation, it has been determined that the property at 3315 Midland Avenue meets Ontario Regulation 9/06, the criteria prescribed for municipal designation under Part IV, Section 29 of the Ontario Heritage Act for its design, associative and contextual value. The owner of the property at 3315 Midland Avenue has submitted a Notice of Intention to demolish a listed heritage property under the Ontario Heritage Act. The application is incomplete. In accordance with Official Plan Heritage Policies, properties on the Heritage Register will be conserved and maintained. Designation enables City Council to review alterations to the site, enforce heritage property standards and maintenance, and refuse demolition.

The Acting Chief Planner and Executive Director, City Planning Division, recommends that: 1. City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act, in accordance with the Statement of Significance: 3315 Midland Avenue (Reasons for Designation) attached as Attachment 3 to the report (November 15, 2017) from the Acting Chief Planner and Executive Director, City Planning Division. 2. If there are no objections to the designation in accordance with the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the necessary bill in Council. 3. If there are objections in accordance with the Ontario Heritage Act, City Council direct the City Clerk to refer the proposed designation to the Conservation Review Board. 4. If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council's decision to designate the property.

113-141 Montezuma Trail - Zoning By-law Amendment Application - Final Report
This application proposes to amend the Zoning By-laws to permit the construction of 37 back-to-back townhouse units on the northern portion of 113-141 Montezuma Trail while retaining the southern portion of the existing plaza for commercial uses. The back-to-back townhouse units are arranged into 2 rows and have a total gross floor area of 4,191 square metres. The retained commercial building will have a total gross floor area of 1,077 square metres. The proposed redevelopment of the subject property results in a floor space index (FSI) of 0.93. While originally submitted as a combined Official Plan and Zoning By-law amendment application, staff have determined that an amendment to the Official Plan is no longer required during the evaluation of the proposal. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2019). The proposed development represents an orderly development for the site that is appropriately scaled for lands designated Neighbourhoods. It is compatible with and provides an appropriate transition to adjacent land uses. The two rows of four-storey townhouses provide an appropriate level of intensification for the site. This report reviews and recommends the approval of the proposed application to amend the Zoning By-laws.

The City Planning Division recommends that: 1. City Council amend the former City of Scarborough Zoning By-law No. 12797, Agincourt North Community Zoning By-law, as amended, for the lands at 113-141 Montezuma Trail substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 6 to the report dated September 23, 2019, from the Director, Community Planning, Scarborough District. 2. City Council amend City of Toronto Zoning By-law 569-2013, as amended, for the lands at 113-141 Montezuma Trail substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 7 to the report dated September 23, 2019, from the Director, Community Planning, Scarborough District 3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required. 4. Before introducing the necessary Bills to City Council for enactment, City Council require the Owner to enter into an Agreement pursuant to Section 37 of the Planning Act to secure the following facilities, services and maters at the owner's expense: a. Prior to issuance of an above grade building permit, other than a building permit for a temporary sales office, the owner shall pay to the City a cash payment of one hundred twenty-five thousand dollars ($125,000.00) to be allocated towards area park improvements in Ward 23 to be determined by the Chief Planner and Executive Director of City Planning in consultation with the local Councillor.

Application to Remove a Private Tree - 95 Pebblehill Square
This report requests that City Council deny the request for a permit to remove one privately owned tree located at 95 Pebblehill Square. The application indicates the reasons for removal are that the tree is too tall and its close proximity to the house makes it dangerous. The subject tree is a Colorado blue spruce (Picea pungens), measuring 46cm in diameter. The Tree By-law does not support the removal of this tree as it is healthy and maintainable.

Metrolinx GO Expansion: Time Extension of Dowry Street Temporary Road Closure
This staff report is about a matter that Community Council has delegated authority to make a final decision provided that it is not amended so that it varies with City policy or by-laws. Metrolinx's contractor EllisDon is currently undertaking infrastructure improvements at the Agincourt GO Station. A 44.1 metre long section of Dowry Street leading up to the Station is currently closed to facilitate construction work. A time extension of the existing road closure on Dowry Street is required from October 12, 2019 to October 31, 2021 to complete the required works.

Scarborough Community Council temporarily close Dowry Street to vehicular traffic between a point 15 metres west of the east end of Dowry Street and a point 44.1 metres further west, from October 12, 2019 to October 31, 2021 inclusive, to facilitate infrastructure improvements at the Agincourt GO Station.

Residential Demolition Application - 2590 Midland Avenue
This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision. In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article II "Demolition Control", the application for the demolition of a dwelling at 2590 Midland Avenue is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building. If the Scarborough Community Council grants issuance of the demolition permit, it may impose conditions if any, to be attached to the demolition permit.

U-Turn Prohibition - Pharmacy Avenue, between Dawes Road and St. Bede's Road
As the Toronto Transit Commission (TTC) operates a transit service on Pharmacy Avenue, City Council approval of this report is required. This report recommends a U-turn prohibition on Pharmacy Avenue, between Dawes Road and St. Bede's Road. Prohibiting U-turns will provide a safer environment for all road users along this section of Pharmacy Avenue, which is in the vicinity of Regent Heights Public School.

This staff report is about a matter that the Community Council has delegated authority from City Council to make a final decision. This report recommends a U-turn prohibition on Sedgemount Drive between Pandora Circle and Daventry Road. This prohibition will reduce conflicts between all users and improve safety along this section of Sedgemount Drive which is a local road in the vicinity of Tredway Woodsworth Public School.
