This report provides information and identifies a preliminary set of issues regarding the Official Plan Amendment and Zoning By-law Amendment application for 212-220 King Street West. This application proposes to redevelop the site with an 80-storey (312 metres including mechanical penthouse) mixed-use development that partially conserves the three heritage buildings on site, adds 588 purpose built rental units, 74,130 square metres of office space and 872 square metres of retail space. Staff are currently reviewing the application. It has been circulated to all appropriate agencies and City divisions for comment. Staff will proceed to schedule a community consultation meeting for the application with the Ward Councillor. In its current form, the application is not supportable due to its lack of conformity with the built form policies in the Official Plan, Downtown Plan and King-Spadina Secondary Plan. While the proposal aims to conserve the designated heritage façades on the site and proposes office and residential rental uses, the proposed height of the development, its fit within the existing and planned policy context, the impacts on the surrounding public realm, and the lack of public benefit this proposal provides, amongst other matters, presents significant concerns. Staff will endeavour to continue collaborative discussions with the applicant in order to resolve these concerns and bring forward a supportable revised proposal to City Council in the future.

City staff have significant concerns with the current form of this proposal. 89 to 109 Niagara Street - Authority to Amend Section 37 Agreement
This report seeks City Council authorization to amend the existing Section 37 Agreement for the properties at 89 to 109 Niagara Street to update and modify conditions related to the heritage conservation strategy and replacement rental housing units, in accordance with revisions arising from the Site Plan Control review process. On August 25, 2014, Council approved site-specific Zoning By-law 644-2015 permitting a redevelopment conserving the heritage buildings along the site's Niagara Street and Tecumseth Street frontages, and the addition of a new building with two taller elements of 12 and 14 storeys in its southerly portion, separated by a large courtyard in the centre of the site. The approved design required vehicles to pass through the courtyard to access the parking garage entrance located on the east side of the site. The rezoning approval secured a specific heritage conservation strategy as well as specific criteria for the replacement of 21 rental housing units in the Section 37 provisions of the by-law and resultant Section 37 Agreement. The properties were designated under Part IV of the Ontario Heritage Act and a Heritage Easement Agreement was registered. A Site Plan approval application was subsequently submitted and reviewed by staff, incorporating several design revisions. The revised proposal continues to conserve the exterior of the heritage properties and will not significantly impact the three dimensional form of the buildings, however the application now proposes the removal and reconstruction of the interior of the buildings to provide level floors, structural strength, fire separations and acoustic mitigation. At the request of City staff, the applicant also worked to relocate and reconfigure the parking garage access to reduce vehicular travel in the courtyard, which necessitated revisions to the southerly building including minor changes to the configurations of the 21 replacement rental housing units. A minor variance application to permit the revised proposal is scheduled to be heard by the Committee of Adjustment on April 28, 2021. Staff support the requested variances, and recommend that City Council authorize the City Solicitor to amend the Section 37 Agreement as necessary, should the Committee of Adjustment approve the variances.
The Toronto and East York Community Council recommends that: 1. City Council authorize the City Solicitor to amend the registered Section 37 Agreement, and any other necessary agreements, satisfactory to the Chief Planner and Executive Director, City Planning, and the City Solicitor, securing the following matters consistent with the provisions of By-law 644-2015 as varied: a. revisions to clauses relating to the location and physical specification of the 21 rental housing units reflecting the individual rental housing floor plans prepared by Core Architects dated April 6, 2020, including provision that no more than four of the 21 rental housing units may have interior bedrooms; and b. revisions to clauses relating to the Heritage Conservation Plan, reflecting the conservation strategy in the Heritage Impact Statement prepared by Philip Goldsmith, Architect, dated July 19, 2019. 2. City Council authorize the City Solicitor and any appropriate City Officials to take such actions as are necessary to implement the foregoing, including execution of the Section 37 Amending Agreement. 3. City Council direct that, prior to final Site Plan Approval for the development at 89 to 109 Niagara Street, the owner be required to enter into the Section 37 Amending Agreement and that the owner has obtained final approval of the Minor Variance application for the subject property.

Vision Zero Road Safety Plan Right-Turn-on-Red Prohibitions - Toronto and East York
This staff report is about right-turn-on-red prohibitions affecting roadways where the Toronto Transit Commission operates bus service, requiring City Council approval. One focus action in the Vision Zero 2.0 Road Safety Plan approved by Council in July 2019 is addressing turning collisions at signalized intersections. This can be addressed through the utilization of several tools, including the strategic application of right-turn-on-red prohibitions. The purpose of this report is to recommend right-turn-on-red prohibitions at six intersections in Toronto and East York Community Council area and presents the decision making process for selection of these intersections.

Danforth Avenue and Gledhill Avenue for southbound traffic; b. O'Connor Drive and Woodbine Avenue for eastbound traffic, except during eastbound right-turn green arrow phase; c. St. Clair Avenue East and Avoca Avenue for northbound and eastbound traffic; d. Dundas Street East and Logan Avenue for eastbound traffic; and e. Harbord Street and Shaw Street for eastbound and westbound traffic.

Safety Review - Mill Street and Cherry Street
The purpose of this report is to respond to Toronto and East York Community Council's direction to review the intersection of Mill Street and Cherry Street and explore potential safety measures for pedestrians, and to report on the findings from the recent Vulnerable Road User Review.

Car-share Vehicle Parking Areas - Stadium Road and Douro Street

This staff report is about a matter that Community Council has delegated authority to make a final decision provided that it is not amended so that it varies with City policy or by-laws. Peter Adelaide Limited Partnership is constructing a 47-storey residential condominium building that includes two-levels of retail space with four-levels of underground parking at 102-118 Peter Street and 350-354 Adelaide Street West. The site is an "L" shaped lot located on the northwest corner of Adelaide Street West and Peter Street. Transportation Services is requesting authorization to close the sidewalk and a 3.1 metre wide portion of the southbound curb lane/parking lane on the west side of Peter Street for a period of 20 months (i.e. May 1, 2021 to December 31, 2022) to accommodate a construction staging area. Pedestrian operations on the west side of Peter Street will be maintained in a covered and protected walkway within the closed portion of the existing lane. The existing bike lane located on the west side of Peter Street will be realigned but will be maintained. However, the closure will result in loss the of approximately 4 parking machine spaces on the west side of Peter Street abutting the site. Two of these spaces are allocated as a motorcycle parking zone. Pedestrian operations on the north side of Adelaide Street West, abutting the site, will be maintained in a covered and protected walkway within the existing sidewalk.

Construction Staging Area Time Extension - 387- 403 Bloor Street East
As the Toronto Transit Commission (TTC) operates a transit service on Bloor Street East, City Council approval of this report is required. SkyGrid Construction Incorporated is constructing a 54-storey residential building and a 10-storey hotel building at 387-403 Bloor Street East. The development site will have frontage on both Bloor Street East and Selby Street. The site is located on the south side of Bloor Street East, one property east of Sherbourne Street. The sidewalk and a portion of the eastbound curb lane on the south side of Bloor Street East fronting the site are currently closed to accommodate construction staging operations for the development. City Council, at its meeting on February 26, 2019, approved the subject construction staging area on Bloor Street East, from March 5, 2019 to March 5, 2020. However, at the time the developer indicated they would require the staging area for a total of 34 months. Subsequently, City Council, at its meeting on June 29 and 30, 2020 approved extending the duration of the construction staging area an additional 12 months, until March 8, 2021. The developer has requested an additional extension of the duration of the construction staging area on Bloor Street East, in order to complete the construction of the development. Based on the information provided by the developer, the site has experienced a number of construction delays due to labour shortages and availability of materials due to COVID-19. Transportation Services is requesting authorization to extend the duration of the construction staging area on Bloor Street East until January 31, 2023, in order to complete the construction of the development.

Transportation Services is requesting authorization to close a 3.2 metre-wide portion of the northbound curb lane on Defries Street, between Labatt Avenue and Mark Street, for a period of 24 months (i.e., April 22, 2021 to April 30, 2023) to accommodate a construction staging area. The construction staging area on the east side of Defries Street will result in the loss of one northbound traffic lane that is currently designated for on-street parking resulting in the loss of eight permit parking spaces.

Construction Staging Area - TTC Easier Access Program - Donlands Station (Phase 2 and 3)
As the Toronto Transit Commission (TTC) operates a transit service on Donlands Avenue, City Council approval of this report is required. Donlands Station, located on the southwest corner of Donlands Avenue and Strathmore Boulevard, is being modernized to accommodate one at-grade elevator and one below-grade elevator at the main station. In addition, a second entrance/exit is also being added to the station that will be located on the east side of Dewhurst Boulevard south of Strathmore Boulevard, as part of the TTC's Easier Access Program and Second Exit Program. Construction of the development will be undertaken in several phases. This report will only deal with matters related to Easier Access Phase 2 and 3 of the construction, located at the main station. Transportation Services is requesting authorization to close the following, for a period of 19 months (i.e., May 6, 2021 to November 30, 2022), to accommodate construction staging operations in Phases 2 and 3 of the Easier Access portion of the Donlands Station modernization. The north sidewalk and a 2.1 metre-wide portion of the westbound curb lane on Strathmore Boulevard, between Donlands Avenue and a point 26 metres west. The south sidewalk and a 3.3 metre-wide portion of the eastbound curb lane on Strathmore Boulevard, between Donlands Avenue and a point 22 metres west. Strathmore Boulevard at Dewhurst Boulevard is currently fully closed to accommodate construction activities related to the Second Exit portion of this project. Update - Construction Staging Area - TTC Second Exit Program - Donlands Station (Phase 2 and 3)
This staff report is about a matter that Community Council has delegated authority to make a final decision provided that it is not amended so that it varies with City policy or by-laws. Toronto and East York Community Council, at its meeting on February 24, 2021, approved the subject construction staging areas on Strathmore Avenue and Dewhurst Boulevard, from February 25, 2021 to April 26, 2021. The purpose of this report is to respond to a number of requests made by Toronto and East York Community Council of the General Manager, Transportation Services, regarding the construction staging areas and to receive approval for the construction staging areas until January 31, 2023. Transportation Services is requesting authorization to continue the closure Strathmore Boulevard in its entirety, between Dewhurst Boulevard and a point 39 metres east for a period of 21 months (i.e., April 27, 2021 to January 31, 2023), to accommodate construction staging operations in Phase 2 and 3. A full closure is currently in place and no vehicular or pedestrian access is being accommodated within the closed section of Strathmore Boulevard, except for walkways on both sides of the street, that are intended to service only the residential properties abutting the closure. In addition, a 5 metre-wide portion of the westbound curb lane on Strathmore Boulevard, immediately east of the full closure to a point 60 metres west of Donlands Avenue is closed in order to accommodate dewatering tanks and storage of construction materials. Furthermore, the east sidewalk and a 5 metre-wide portion of the northbound lane on Dewhurst Boulevard has been closed, between a point 40 metres north of Danforth Avenue (the first lane north of Danforth Avenue, east of Dewhurst Boulevard) and a point 65 metres further north. This closure requires that Dewhurst Boulevard operate as one way southbound only, abutting the closed portion of the street. Transportation Services is also seeking closures in the area of Donlands Avenue and Strathmore Boulevard to accommodate construction staging areas for the Donlands Station - Easier Access portion of the station modernization. Since the two tasks are operating on slightly different schedules, Transportation Services, for reporting purposes, will be addressing the "Easier Access" and "Second Entrance/Exit" individually. This report will deal with Phase 2 and 3 of the "Second Entrance/Exit "only.
