The Scarborough Community Council: 1. Granted a fence exemption permit to the property owner of 17 Bellehaven Crescent, on the condition that the current fence be altered no later than February 19, 2027 as follows: a. Alter each of the three existing gates (two driveway and one pedestrian) by implementing open-fence construction as defined under Municipal Code Chapter 447-1.2(C)(1), notwithstanding the reference to 2.4 metres, to improve sight of line consistent with the safety policy goals of the by-law, consistent with the conceptual rendering in Exhibit A of Attachment 1 to the motion by Councillor Kandavel; b.

Replace the fence from the north-east corner south to the existing first post on the east side of the property, being a length of approximately 1.5 metres, with fencing of an open-fence construction as defined under Municipal Code Chapter 447-1.2(C)(1), notwithstanding the reference to 2.4 metres, to an approximate height of 1.2 metres, as set out under Municipal Code Chapter 447-1.2(B)(1), consistent with the conceptual rendering in Exhibit A of Attachment to the motion by Councillor Kandavel; c. Replace the fence from the north-east corner west to the existing first column gate post on the north (front) side of the property, being a length of approximately 4 metres, with fencing of an open-fence construction as defined under Municipal Code Chapter 447-1.2(C)(1), notwithstanding the reference to 2.4 metres, to an approximate height of 1.2 metres, as set out under Municipal Code Chapter 447-1.2(B)(1), consistent with the conceptual rendering in Exhibit A of Attachment 1 to the motion by Councillor Kandavel. 2. Required that at such time as replacement of the fence is required, the installation comply with Municipal Code Chapter 447, Fences, or its successor by-law.

This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application by the owner(s) of 17 Bellehaven Crescent to allow the current north property line fence/gates to remain at a height between 1.91 meters (6.2 feet) and 2.3 meters (7.54 feet) which exceeds the maximum height requirements of 1.2m (4ft).

The District Manager, Municipal Licensing and Standards, East District recommends that: 1. Scarborough Community Council refuse to grant the application for an exemption permit, by the owner(s) of 17 Bellehaven Crescent to use the existing fence at it's current heights.
