Final Report - 4700 Keele Street - The Quad Phase 2 - Zoning By-law Amendment Application
This application proposes to amend the Zoning By-law to permit two eight (8) storey (25.65 metre high plus mechanical penthouse) private academic accommodations with non-residential uses at grade, located in the south-east quadrant of The Pond Road and Sentinel Road, south of the York University campus. The proposed private academic accommodations would contain approximately 444 residential units and 1,326 square metres of retail comprising 26,997 square metres of total gross floor area at 4700 Keele Street. The proposal is the second phase of a private student housing development known as The Quad, located on the south side of The Pond Road. The proposed development is compatible with its surrounding context. The proposal introduces an appropriate built form to the site with development massed to address the corner of The Pond Road and the extension of Haynes Avenue. The proposed landscaping will provide an improved public realm on The Pond Road, the extension of Haynes Avenue and the extension of Leitch Avenue. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2019). The proposal conforms to the applicable Official Plan policies and complies with the York University Secondary Plan. The proposed development also forms part of the Southwest Precinct Plan Study Area which is currently under review. The Southwest Precinct Plan is envisioned as a medium density urban village with a variety of housing opportunities, shops and services with a neighbourhood square to provide social gathering opportunities and an identity for the precinct. As part of the Precinct Plan, Urban Design Guidelines and supporting strategies are required, including an Affordable Housing Strategy. The Precinct Plan, Urban Guidelines and supporting strategies are currently being finalized. This report reviews and recommends approval of the application to amend the Zoning By-law, with the Bills being held, subject to the finalization of the Southwest Precinct Plan, Urban Design Guidelines and supporting strategies.

The City Planning Division recommends that: 1. City Council amend Zoning By-law 7625, for the lands at 4700 Keele Street substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 6 to this report. 2. City Council authorizes the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required. 3. Before introducing the necessary Bill to City Council for enactment, require the owner to provide the final versions of the Southwest Precinct Plan, the accompanying Urban Design Guidelines and the supporting strategies, all to be to the satisfaction of the Director, Community Planning, Etobicoke York District. 4. Before introducing the necessary Zoning Bill to City Council for enactment, City Council require the Owner to enter into an Agreement pursuant to Section 37 of the Planning Act to secure the following: a. Participate in the City's Percent Public Art Program and provide a cash contribution to the City of $500,000.00, in accordance with a Public Art Plan submitted by the owner to the satisfaction of the City. The cash contribution shall be paid prior to the issuance of the first above grade building permit. The financial contribution amount shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto for the period from the date of the registration of the Section 37 Agreement to the date of payment for the public art. b. Prior to the issuance of the first above grade building permit, the Owner shall make a cash contribution to the City in the amount of $1,500,000.00 to be used for local park improvements to be determined by the Director of Community Planning, Etobicoke York District in consultation with the Ward Councillor. The financial contribution amount shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto for the period from the date of the registration of the Section 37 Agreement to the date of payment for the local park improvements. c. The owner shall provide a minimum of 7.4% of the private academic accommodations in Buildings C3 and C4 as affordable rental housing in accordance with the following provisions which shall be further set out in the Section 37 agreement with the City and to the satisfaction of the Chief Planner and Executive Director, City Planning Division: i. The affordable rental housing will comprise a minimum of 7.4% of the private academic bedroom accommodations within a range of residence unit types comprising bachelor, 1, 2, 3 and 4 bedrooms. ii. The owner will maintain the private academic affordable bedroom accommodations in Buildings C3 and C4 as rental housing, and agrees that none of the rental housing will form part of an application for Condominium Registration for at least fifteen years from the date upon which the first new rental housing unit is occupied. iii. Affordable rents will be charged to the tenants who occupy one of the affordable bedroom accommodations for a period of 15 years following the initial occupancy of each of buildings C3 and C4, providing that the affordable rental bedroom accommodations commence occupancy at the same time, subject to the provisions in 4.c. (iv) and (v). iv. The affordable rents will be based on an average rent level derived from an average rent for comparable existing student residence accommodations on the York University campus for the academic year in which the affordable rental bedroom accommodations will be occupied, adjusted further to reflect differences in lease terms and arrangements for television services in the private academic accommodations, and varied by residence unit type and to reflect single or shared bedroom accommodations. v. After the expiry of the 15 year period, rents charged to tenants newly occupying one of the affordable rental bedroom accommodations will not be subject to restrictions by the City of Toronto under the terms of the Section 37 Agreement entered into under this by-law. vi. Eligibility criteria for students who rent one of the affordable rental bedroom accommodations will require that such student is receiving financial assistance under the Ontario Student Assistance Program. vii. The residence units which contain affordable rental bedroom accommodations shall be furnished and equipped with kitchen and bathroom facilities. d. The following matters are to be secured in the Section37 Agreement as a Legal convenience: i. The applicant shall provide an easement in favour of the City of Toronto in the form of the Privately Owned Publically Accessible (POPS) space on the site in the form of a publicly accessible square located at the southeast corner of The Pond Road and the extension of Haynes Avenue, as illustrated on the conceptual Landscape Plans issued on October 18, 2019. Any changes to the proposed POPS space shall be to the satisfaction of the Chief Planner and Executive Director, City Planning. ii. The applicant shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, Version 3.

This report provides information and identifies a preliminary set of issues regarding the application to amend the Official Plan, the former City of York Zoning By-law No. 1-83 (as amended by By-law No. 244-2005) and City-Wide Zoning By-law No. 569-2013, for the lands municipally known as 1956, 1966, 1970, 1972, 1974, 1976, 1978, 1980, 1982, 1984 and 1986 Weston Road and 1 Little Avenue. The application proposes two tall buildings with heights of 29-storeys (100 m in height, including the mechanical penthouses) connected by a 12-storey podium (41 m in height). The buildings would contain 3,991 m 2 of non-residential floor area on the first and second floors and 592 residential units above. The buildings would have a gross floor area of approximately 61,316 m 2 , yielding a Floor Space Index (FSI) of approximately 12.2 times the area of the lot. A total of 174 parking spaces would be provided at-grade and within a two level below-grade parking garage. Vehicular access to the site would be provided via a private laneway at the rear of the site. Staff are currently reviewing the application. It has been circulated to all appropriate agencies and City divisions for comment. Staff held a community consultation meeting on November 28, 2019 for the application, together with the Ward Councillor. Information on the meeting is provided in the Committee Section of this report. The Ward Councillor requested an extended notification area and a total of 5,660 notices were mailed to land owners.
Etobicoke York Community Council: 1. Directed that the additional mailing costs resulting from the expanded notification area (beyond 120 m from the site) for the November 28, 2019 community consultation meeting be borne by the applicant. 2. Directed staff to continue to work with the applicant to address the issues identified in the report (December 9, 2019) from the Director, Community Planning, Etobicoke York District, and any additional issues that may be identified through the continuing review of the application, agency comments and the community consultation process. 3. Directed that prior to submitting any further report to the Etobicoke York Community Council for the application located at 1956, 1966, 1970, 1972, 1974, 1976, 1978, 1980, 1982, 1984 and 1986 Weston Road and 1 Little Avenue, staff schedule another community consultation meeting, together with the Ward Councillor, with notice for the community consultation meeting given to land owners and residents within 240 metres of the site, and expanded in consultation with the Ward Councillor, with the additional cost to be borne by the applicant.

The purpose of this report is to present the results of a study regarding the need for a Pedestrian Crossover (PXO) on Gunns Road, between Lavender Creek Trail and the driveway of the Stockyards Shopping Centre (north entrance). A staff assessment concludes that the PXO warrant requirements are not fully satisfied at this location.

Proposed Installation of Traffic Control Signals - Eglinton Avenue West, west of Pearen Street
As the Toronto Transit Commission (TTC) operates bus service on Eglinton Avenue West, City Council approval of this report is required. The TTC has been advised on this matter. Transportation Services is recommending installation of a mid-block pedestrian signal on Eglinton Avenue West, west of Pearen Street. This installation is recommended based on the pedestrian activity in the vicinity and the long spacing to adjacent pedestrian crossing protection. A pedestrian signal will enhance safety for pedestrians but may increase delays for east-west motorists.

Speed Limit Amendment - Wendell Avenue (between Gary Drive and Queenslea Avenue)
Wendell Avenue is an 8.5 metre wide roadway classified as a "collector" road. This street has a two-way operation, with sidewalks on both sides of the street. Wendell Avenue, north of Gary Drive, has traffic calming, pinch points and a 30 km/h speed limit. South of Gary Drive, the speed limit on Wendell Avenue is 40 km/h. I have heard from residents of Wendell Avenue, south of Gary Drive, who would like to see the speed limit on this section of the street reduced to 30 km/h. I believe that it is in the public's interest to reduce the speed limit on this section of the road to make the speed limit consistent with Wendell Avenue, north of Gary Drive.

This report outlines the results of an investigation into installing speed humps on Clearview Heights, between Trethewey Drive (east intersection) and Trethewey Drive (west intersection). The results indicate that the criteria to justify installing speed humps are not satisfied.

Standing Prohibition - Viella Street

Speed Limit Amendment - Old Weston Road (between Lavender Road and Rogers Road)
On December 3, 2019, with the adoption of item TE11.73, Toronto and East York Community Council approved a reduction in the speed limit on Old Weston Road, between Davenport Road and Lavender Road, from 50 km/h to 40 km/h. The remaining stretch of Old Weston Road, between Lavender Road and Rogers Road, falls within the boundaries of Etobicoke York Community Council and continues to have a speed limit of 50 km/h. The speed limit should be reduced so that all of Old Weston Road has a 40 km/h speed limit.

Golf Canada will hold the 2020 RBC Canadian Open at St. George's Golf and Country Club from June 8 -14, 2020. Previously St. George's hosted the event in 2010. In order to accommodate the event, there are temporary road closures, parking restrictions and permits required. The venue also includes a partnership with the Toronto District School Board, at Richview Collegiate. Golf Canada are hosting a number of information meetings for residents and stakeholders. Although there are notification procedures, one or more temporary mobile signs would be a beneficial supplement in providing notice of the meetings to the public, and to advise of the road closures. Municipal Code Chapter 693 outlines the requirements for signs being used to advertise community events, and does not have a procedure to permit variance or appeal to the criteria which regulate temporary signage. I propose that exemptions be provided to Golf Canada to Chapter 693 to allow one or more temporary mobile signs to be placed in the public right of way, if needed, subject to the satisfaction of the General Manager of Transportation Services, as a means to help promote citizen participation in the meetings.
