This application requests a Part Lot Control Exemption for a portion of the lands formerly known as 115 Torbarrie Road (Parts 109-113 of Block 152 and Lot 1 on Plan 66M-2436). The site was subject to previous Part Lot Control Exemptions for the creation of conveyable lots for the development of 224 townhouse dwelling and 24 pairs of semi-detached dwelling units which have expired. This Part Lot Control Exemption would only apply to the six remaining lots that have not yet been conveyed to individual purchasers. The exemption from the Part Lot Control provisions of the Planning Act would permit the creation of conveyable lots for the development of the remaining dwelling units. The proposal complies with the existing Official Plan and Zoning By-law. The lifting of Part Lot Control for a period of two years is considered appropriate for the orderly development of these lands. This report reviews and recommends approval of the Part Lot Control Exemption.

The Zoning By-Law Amendment application proposes to amend the Etobicoke Zoning Code (amending By-law No. 717-2006) and to lift the Holding Provision "(h)" from the site to permit an 8-storey (31.9 m in height, including the mechanical penthouse) residential building with 114 units (including 12 proposed replacement rental dwelling units and 10 at grade residential units integrated into the building podium) and a below grade parking garage at 4125-4133 Dundas Street West. The proposed development would include a residential gross floor area of 9,868 m² representing an overall building density of 3.29 times the lot area. The applicant is proposing to demolish three existing buildings on the site including one 3-storey residential rental building with 6 rental dwelling units, one 2-storey mixed-use building with 6 rental dwelling units and one commercial building. An application for Rental Housing Demolition and Conversion under Section 111 of the City of Toronto Act (Chapter 667 of the Municipal Code) has been submitted to permit the demolition of the 12 existing rental dwelling units at 4125-4133 Dundas Street West. The applicant has proposed to replace all existing rental dwelling units within the proposed building and provide tenant relocation and assistance to all eligible tenants. The proposal is appropriate for the site and is compatible with the existing surrounding area and the planned context. Further, the proposal is consistent with the pattern and scale of redevelopment along Dundas Street West in this area and represents appropriate intensification and built form on an Avenue. The proposed development conforms to Site and Area Specific Policy 277, the Dundas Street West Avenue Area Urban Design Guidelines and supports the vision of the Dundas Street West Avenue Study. The proposed development is consistent with the Provincial Policy Statement (2014), conforms with the Growth Plan for the Greater Golden Horseshoe (2017) and conforms to the City of Toronto Official Plan. Staff recommend lifting of the "H" Holding Symbol from the site as conditions pertaining to availability of all road improvements, infrastructure, servicing and school capacity to accommodate the proposed development are satisfied. This report reviews and recommends approval of the application to amend the Zoning By-law and lifting of the "H" Holding Symbol from the site as set out in Attachment 5 to this report. Further, this report reviews and recommends approval of the application for Rental Housing Demolition Application under Section 111 of the City of Toronto Act, subject to conditions.

Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act to secure the following matters: a. The owner shall provide and maintain not less than 12 replacement rental dwelling units, comprised of 2 bachelor units, 3 one-bedroom units, 6 two-bedroom units and 1 three-bedroom unit, at 4125 - 4133 Dundas Street West for a period of at least 20 years, as generally shown on the plans submitted to the City Planning Division dated July 11, 2018. Any revision to these plans must be to the satisfaction of the Chief Planner and Executive Director, City Planning; b. The owner shall provide at least 2 bachelor, 3 one-bedroom, and 4 two- bedroom replacement rental dwelling units at affordable rents, for a period of at least 10 years and at least 2 two-bedroom and 1 three bedroom replacement rental dwelling units at mid-range rents for a period of at least 10 years, beginning from the date that each replacement rental dwelling unit is first occupied; c. The owner shall provide ensuite laundry in all replacement rental dwelling units; d. The owner shall provide storage lockers to all tenants of the replacement rental dwelling units; e. The owner shall provide tenants of the replacement rental dwelling units access to all the indoor and outdoor amenity spaces in the building on the same terms and conditions as the occupants of the remainder of the building; f. The owner shall provide tenants of the replacement rental dwelling units with access to at least 6 residential vehicle parking spaces, with returning tenants who were using one of the existing resident parking spaces receiving first priority, and bicycle parking spaces equal to the same ratio as bicycle parking spaces required to be provided for occupants of the remainder of the building; g. The issuance of the Notice of Approval Conditions for site plan approval by the Chief Planner and Executive Director, City Planning or his designate, pursuant to Section 114 of the City of Toronto Act, 2006; d. The issuance of excavation and shoring permits for the approved redevelopment of the site; and e. The execution and registration of a Section 37 Agreement pursuant to the Planning Act securing Parts 4.a-g. above and any other requirements of the Zoning By-law Amendment. 6. City Council authorize the Chief Building Official to issue a Rental Housing Demolition permit under Municipal Code Chapter 667 for 4125-4133 Dundas Street West after the Chief Planner and Executive Director, City Planning has given the preliminary approval referred to in Part 5 above for the demolition of the existing 12 rental dwelling units. 7. City Council authorize the Chief Building Official to issue a permit under Section 33 of the Planning Act for the demolition of 12 existing residential units at 4125-4133 Dundas Street West no earlier than the issuance of the first Building Permit for excavation and shoring of the development and after the Chief Planner and Executive Director, City Planning has given the preliminary approval referred to in Part 5 above, which permit may be included in the demolition permit for Chapter 667 under 363-11.1, of the Municipal Code, on the condition that: a. The owner erect a residential building on site no later than (three) 3 years from the day demolition of the buildings is commenced; and b. Should the owner fail to complete the new building within the time specified in Part 7a above, the City Clerk shall be entitled to enter on the collector's roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000.00) for each dwelling unit for which a demolition permit is issued, and that each sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued. 8. City Council authorize the appropriate City officials to take such actions as are necessary to implement the foregoing, including execution of the Section 111 Agreement. 9. City Council require the following to be secured through a Site Plan Agreement: a. The owner shall construct and maintain the development in accordance with the Tier 1 performance measures of the Toronto Green Standard. b. The owner shall satisfy the requirements of the Toronto District School Board regarding warning clauses and signage with respect to school accommodation issues. c. The owner shall address and secure other matters including: wind study requirements, road widenings and conveyance, streetscaping improvements, and the design/location of the TTC bus shelter through the Site Plan process.

Final Report - 2 Gibbs Road - Application to Lift Holding Provisions "(H)"
The purpose of this report is to recommend lifting the Holding Provision "(h)" symbol pertaining to the southwest portion of the site at 2 Gibbs Road (Phases 2 and 3 of a mixed-use development). The lifting of the "(h)" on the subject site will provide for the development of two residential condominium towers (Tower 2 being 37 storeys and Tower 3 being 43 storeys in height) above a 4-storey podium including retail and office space and 6 townhouses; a central garden (privately owned publicly accessible open space); 2 levels of underground parking; and 4 levels of above grade parking on the site. Phases 2 and 3 are part of the larger mixed-use phased development at 2 Gibbs Road containing a total gross floor area of 105,600 m² as approved by City Council at its meeting of March 28 and 29, 2017 and through technical by-law amendments approved by City Council on January 31 and February 1, 2018. The Holding Provision requires that prior to the lifting of the "(h)" the applicant is required to demonstrate adequate servicing capacity through flow monitoring on the existing municipal sanitary system and that satisfactory arrangements be made with the General Manager and Executive Director of Engineering and Construction Services, including any necessary agreements with the City for the design and construction of any improvements to the municipal infrastructure. These conditions have been satisfied. The proposed development is also consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2017). This report reviews and recommends approval of the application to amend Zoning By-law Nos. 320-2017 and 321-2017.

Preliminary Report - 2996 Weston Road - Zoning By-law Amendment Application
This report provides preliminary information and an early opportunity to raise issues for follow-up with regard to the application. It seeks Community Council's direction on the community consultation process and indicates the expected timing for a Final Report to City Council. The application has been circulated to all appropriate agencies and City divisions for comment and a staff review of the application is underway. This application proposes to amend the former City of North York Zoning By-law and the City-Wide Zoning By-law to permit six 3-storey single-detached dwellings on lands municipally known as 2996 Weston Road. Four of the dwellings are proposed to have frontages on George McKenzie Court, while the remaining dwellings would front onto Weston Road. The subject property is partially located on lands that are regulated by the Toronto and Region Conservation Authority (TRCA) and the Ravine and Natural Features Protection By-law. The applicant requested a pre-application consultation meeting for assistance in defining the requirements for application submission. Staff held the meeting with the applicant on October 25, 2017. A notice of complete application with regard to the application was issued on May 23, 2018. A community consultation meeting is anticipated to be held in the first quarter of 2019. A Final Report will be submitted for Council's consideration following community consultation; the resolution of outstanding issues related to this application; and the holding of a statutory Public Meeting under the Planning Act. The target timeline for the Final Report is anticipated to be during the second quarter of 2019.

Reducing the Speed Limit on Liscombe Road to 30km/hr, between Maple Leaf Drive and Rustic Road
Liscombe Road is a two-lane 8.5 metres wide road classified in the City's Road Classification System as a local road. This street is located in the residential community east of Jane Street, south of Highway 401. Sidewalks are absent on both sides of the roadway. A number of residents on Liscombe Road have contacted my office to share their concerns about speed and volume issues on their street. Residents regularly observe motorists travelling at high speeds, which is most concerning to the many families and children walking to and from the nearby Maple Leaf Park and Rustic Park. At a public meeting held on September 9, 2015 (former Ward 12), residents were concerned about speeding on Liscombe Road. In response, Transportation Services conducted speed and volume counts. Furthermore, a study was then conducted to investigate the feasibility of lowering the speed limit from 40km/hr to 30 km/hr, but Council postponed consideration of this item. The Speed Limit Warrant Analysis showed that the majority of vehicles were travelling at speeds above 40 km/hr.

Endorsement of Events for Liquor Licensing Purposes
Seeking endorsement of various events for liquor licensing purposes.
Etobicoke York Community Council, under its delegated authority, declared for liquor licensing purposes, the following events to be of municipal significance, and directed that the Alcohol and Gaming Commission of Ontario be advised that the Community Council has no objection to their taking place: 1. The night-time disco party to be held at 500 Keele Street on February 22, 2019, from 10:00 p.m. to 4:00 a.m. 2. The Annual Rotary Club Canada Day Ribfest event to be held in Centennial Park, from June 28 to July 1, 2019, from 11:00 a.m. to 11:00 p.m.

The Annual Rotary Club Canada Day Ribfest is an annual event that is held in Centennial Park in conjunction with City of Toronto Canada Day celebrations. The annual event is from June 28 through July 1, 2019 at Centennial Park from 11:00 am - 11:00 pm daily. I fully endorse the plans to hold this event again this year as we have done in previous years. Municipal Code Chapter 693 outlines the requirements for signs being used to advertise charitable, non-profit and community events, and does not permit variance or appeal to the criteria which regulate temporary signage. The approval conditions ensure that there is a responsive procedure to address any signs which have generated a complaint, and ensure all signs are maintained and removed to the satisfaction of City Staff.
Etobicoke York Community Council approved a special permit to the Rotary Club for their 2019 Canada Day event, to allow the placement of signage in accordance with the following conditions: 1. Signs are to be mounted on poles (utility, traffic and hydro poles) no higher than 1.0 meters off the ground to prevent site line obstructions. 2. Signs are not to be placed on the sidewalk or center median poles, as to not impede pedestrian traffic. 3. Ribfest organizers must arrange for the removal of the Ribfest signs no later than 24 hours after the event. 4. If a complaint comes in about a sign, Ribfest organizers must go out the same day to fix the problem and move the sign to another location. 5. Ribfest Organizers must provide a list of all sign locations for approval from Transportation Services. 6. Any other requirements from the Supervisor of Right-of-Way.

Request for Attendance at a Toronto Local Appeal Body Hearing - 65 Fortieth Street
This motion will give the City Solicitor authority to appeal the Committee of Adjustment's decision approving the applications for consent and minor variance respecting 65 Fortieth Street (Application Nos.: B0016/18EYK, A0127/18EYK, and A0137/18EYK) (collectively, the "Applications") to the Toronto Local Appeal Body (the "LPAT"). In order to meet the appeal deadline of February 13, 2019 and crystalize the City's appeal rights for these applications, the City Solicitor has already appealed this matter to the TLAB. As a result, this matter is time sensitive and urgent and is required to allow the City to continue with this appeal. On January 24, 2019, the Etobicoke District Panel of the Committee of Adjustment (the "Committee") approved an application related to the property municipally known as 65 Fortieth Street for consent to sever and two associated applications for minor variances (collectively the "Applications"). The Applications seek to demolish the existing residential dwelling, sever the subject property into two residential lots, and build two new single detached dwellings with integral garages. The Applications required various variances to City-wide Zoning By-law No. 569-2013 such as for lot frontage, lot area, and floor space index. In a report from the Supervisor, Tree Protection and Plan Review - West District, dated May 10, 2018, Urban Forestry Staff is opposed to the requested variances in the Applications on the basis that the Applications will result in the injury or removal of a healthy tree. Urban Forestry Staff are of the opinion that, as indicated in the City's Official Plan, healthy trees are a valuable part of the Urban Forest and should be retained.
Etobicoke York Community Council recommends that: 1. City Council authorize the City Solicitor to appeal the Committee of Adjustment's decisions regarding consent and minor variance Application Nos. B0016/18EYK, A0127/18EYK, and A0137/18EYK respecting 65 Fortieth Street. 2. City Council authorize the City Solicitor and appropriate City staff to attend the Toronto Local Appeal Body hearing to oppose Application Nos. B0016/18EYK, A0127/18EYK and A0137/18EYK respecting 65 Fortieth Street, and to retain outside consultants as necessary. 3. City Council authorize the City Solicitor to resolve the appeals in her discretion and in consultation with the Ward Councillor and the Director of Community Planning, Etobicoke York District.
