Request for Fence Exemption - Front Yard and Side Yard - 45 Dunstall Crescent
This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Council concerning an application by the owner(s) of 45 Dunstall Crescent for a site-specific Fence Exemption, pursuant to Section 447-2 of Toronto Municipal Code, Chapter 447- Fences. The property owners are seeking Council's permission to be exempt concerning an existing wood fence located in the front yard in the South side of the property, as well as the existing wood fence located in the North side yard of the property, which does not comply with restrictions contrary to Section 447-2 of the bylaw as detailed below in the following chart: The subject property 45 Dunstall Crescent is located in Ward #25, in a residential zone property. The Scarborough Community Council: 1. Granted the application for a fence exemption for the existing 2.25 meter high wood fence located in the front yard of the property, as well as a 2.3 meter high wood fence located in the side yard of the property without conditions. 2. Directed and required that the installation be maintained in good repair without alteration. Directed and required that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

The purpose of this report is to advise Council concerning an application by the owners of 81 Shellamwood Trail for a site-specific Fence Exemption, pursuant to Section 447 1.3 of Toronto Municipal Code, Chapter 447- Fences. 8861 Sheppard Avenue East- Zoning Amendment and Lift of Hold Applications - Final Report
This application proposes to amend the former City of Scarborough zoning by-laws to establish appropriate development standards for a permitted 343 m2 place of worship at 8861 Sheppard Avenue East and to incorporate the site into the City-wide Zoning By-law No. 569-2013 under the Institutional Place of Worship (IPW) Zone. To allow for the place of worship, the holding provisions ("H") tied to the subject site also needs to be lifted. The holding "H" provisions in the Rouge Employment District require certain pieces of infrastructure to be in place to service the site. These conditions have been satisified. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2017). The proposal meets the intent of the Mixed Use Areas policies of the Official Plan. The development proposal is appropriate for the site and the surrounding land uses. This report recommends approval of the applications to amend the Zoning By-law and lift the holding ("H") provision.
The Scarborough Community Council recommends that: 1. City Council amend former City of Scarborough Zoning By-law 15907 (Rouge Community Zoning By-law) and former City of Scarborough Zoning By-law 24982 (Rouge Employment District), for the lands at 8861 Sheppard Avenue East substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 5 to the report (December 19, 2018), from the Director, Community Planning, Scarborough District. 2. City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 8861 Sheppard Avenue East substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 6 to the report (December 19, 2018), from the Director, Community Planning, Scarborough District. 3. Enter into a financially secured Development Agreement with the City to provide the detailed design and construction of the sanitary sewer extension, site sanitary sewer and water main connections to the property line to service the subject site, according to the June 6, 2018 Functional Servicing Report accepted by the Chief Engineer and Executive Director of Engineering and Construction Services and provide financial security, engineering and inspection fees in the amount to be determined based on the detailed engineering design, and provide insurance as required; b. A revised Functional Serving Report must be submitted to confirm whether or not the receiving sewer system has the capacity to accommodate groundwater and the flows anticipated to be generated by this site should any modification be made. The owner must pay for and construct the necessary improvements to the storm or sanitary sewer to support this development in conjunction with the other municipal improvements that are identified under Recommendation 4(a). c. Prepare and submit an Environmental Compliance Approval (ECA) Application for Municipal Water Systems and Sewer Works under Transfer of Review for the Ministry of Environment and Climate Change (MOECC) for the extension of the sanitary sewer main to the property line, prior to obtaining the Release for Construction.

6435, 6441 and 6443 Kingston Rd - Part Lot Control Exemption Application - Final Report
This application requests exemption from the Part Lot Control provisions of the Planning Act for the lands municipally known as 6435, 6441 and 6443 Kingston Road to create six (6) lots with a semi-detached dwelling unit on each lot. The subject lands are within a registered plan of subdivision. This report reviews and recommends approval of Part Lot Control Exemption. This application will facilitate orderly development of land which is consistent with the Provincial Policy Statement (2014) and is consistent with the Growth Plan of the Greater Golden Horseshoe (2017).
The Scarborough Community Council recommends that: 1. City Council enact a Part Lot Control Exemption By-law with respect to the subject lands at 6435, 6441 and 6443 Kingston Road (Lots 1, 9 and 17 on Plan 66M-2548) as generally illustrated on Attachments 2, 3 and 4 to the report (December 5, 2018) from the Director, Community Planning, Scarborough District to be prepared to the satisfaction of the City Solicitor and to expire one year following enactment by City Council. 2. 300 Danforth Road - Zoning By-Law Amendment Application - Request for Interim Directions Report
This report responds to an application where staff are currently not in a position to provide a Final Report to Council, but which could be appealed to the Local Planning Appeal Tribunal (the "LPAT") due to Council's failure to make a decision on the application within the time prescribed by the Planning Act. It seeks Community Council's direction on the community consultation. The application has been circulated to all appropriate agencies and City divisions for comment and a staff review of the application is underway. The report sets out outstanding issues related to the application and makes an initial determination as to whether or not the application is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2017). This application proposes to amend to the former City of Scarborough Warden Woods Community Zoning By-law No. 950-2005, as amended, and City of Toronto Zoning By-law No. 569-2013, as amended, to permit 4 blocks of 4-storey stacked townhouses and one 12-storey mixed-use building on the subject property. The proposed development would have a total gross floor area of 21,809 m2, consisting of 162 m2 of retail/commercial space, 504 m2 of non-residential uses and 21,143 m2 of residential uses. A Floor Space Index of 3.07 is proposed. The application proposes a total of 241 residential units of which 161 units would be contained in the mixed-use building and 80 units in the stacked townhouses. One type "G" loading space, 302 vehicular and 277 bicycle parking spaces would be provided to service the proposed development. The proposed development is not supportable in its current form and it has not demonstrated how it respects and reinforces the character of the Neighbourhoods as well as the planned context and vision for Mixed Use Areas in the Warden Woods Secondary Plan. It is Staff's opinion that the proposed development is not consistent with the Provincial Policy Statement (2014), does not conform with the Growth Plan for the Greater Golden Horseshoe (2017) and is not in keeping with the intent of the City's Official Plan.
The Scarborough Community Council recommends that: 1. City Council direct City Staff to schedule a community consultation meeting for the lands at 300 Danforth Road together with the Ward Councillor. 2. City Council direct City Planning Staff that Notice for the community consultation meeting be expanded to the area generally bounded by Bell Estate Rd. and Pilkington Dr. to the north, Warden Ave. to the west, Mack Ave. to the south and Danforth Rd. to the east, as laid out in the map attached to motion 1, moved by Councillor Gary Crawford, and that the additional costs for Notice beyond the 120 metres from the subject site be borne by the Applicant. 3. Notice for the statutory public meeting under the Planning Act be given according to the regulations of the Planning Act. 4. City Council direct City Staff to continue working with the applicant to resolve outstanding issues identified in the report (December 20, 2018) from the Director, Community Planning, Scarborough District. 5. City Council direct the City Solicitor and appropriate City Staff to attend and oppose the application in its current form, should the application be appealed to the Local Planning Appeal Tribunal (LPAT) on the basis of Council's failure to make a decision on the application within the statutory timeframe of the Planning Act. 6. In the event that the Local Planning Appeal Tribunal (LPAT) allows an appeal, in whole or in part, City Council direct the City Solicitor to request the LPAT withhold its Order on the Zoning By-law Amendment until: a. A draft Zoning By-law Amendment is submitted to the satisfaction of the Chief Planner and Executive Director, City Planning Division and the City Solicitor. b. The owner has entered into an Agreement under Section 37 of the Planning Act with the City for the purpose of securing community benefits and public art if the proposed development is approved by the LPAT in its current form, or a prorated quantum if the development is approved with a reduction in the number of proposed buildings, the building heights and density. c. The owner has submitted to the satisfaction of the Executive Director, Engineering and Construction Services an updated Traffic Study, a Functional Servicing and Stormwater Management Report and plans. In addition, the owner would be required to enter into an agreement(s) for the construction of any improvements to existing municipal infrastructure, should it be determined that upgrades are required to support this development.

Golden Mile Secondary Plan Study Status Update and Proposed Boundary Expansion
This report provides information on the status of the Golden Mile Secondary Plan ("GMSP") Study and recommends the expansion of the study area boundaries to include additional lands west of Victoria Park Avenue and along the southern boundary (south of Eglinton Avenue East). As a result of the recommended expansion, the Study Area would increase from 97 to 113 hectares. The existing GMSP study area is bounded by Ashtonbee Road and the Gatineau Hydro Corridor (the "Meadoway") to the north, an irregular boundary to the south, Birchmount Road to the east, and Victoria Park Avenue to the west (refer to Attachment 1). The Study area includes lands that are predominantly designated Mixed Use Areas and Employment Areas, as well as smaller portions designated Apartment Neighbourhoods, Neighbourhoods, and Parks and Open Space Areas - Parks.
The Scarborough Community Council: 1. Referred the item to the Director, Community Planning, Scarborough District for a report back in the first quarter of 2019 to allow the local councillors affected by the outcome of the decision to be informed as to the intent of the boundary expansion, with meaningful discussions, meetings and/or information meetings held with the affected landowners and community representative prior to moving forward with any alteration to the study boundary.

Residential Demolition Application - 801-803 Danforth Road
This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision. In accordance with city-wide residential demolition control under Article II, Demolition Control, of Municipal Code Chapter 363, as amended by By-law No. 1009-2006, enacted by City Council on September 27, 2006 under the authority of Section 33 of the Planning Act, the application for the demolition of a vacant single family dwelling at 801-803 Danforth Road is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building. If the Scarborough Community Council grants issuance of the demolition permit, it may impose conditions, if any, to be attached to the demolition permit.
The Scarborough Community Council: 1. Approved the application to demolish the existing residential building located at the premises municipally known as 801-803 Danforth Road with the following conditions: a. That a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official. b. This report recommends amending the by-law for the one-way traffic lane designation for the southbound right-turn lane on Kingston Road at St Clair Avenue East for right turns only to include a bus exemption for the new Toronto Transit Commission (TTC) buses that service the route at this intersection. The "Buses Excepted" signs will clearly define traffic lane usage, eliminate confusion, and reduce the potential for an incident as TTC vehicles continue to travel through in the southbound direction from the right-turn lane.

Appeal to Toronto Local Appeal Body of Committee of Adjustment Applications for 25 Manhattan Drive
On December 13, 2018, the Committee of Adjustment (the "Committee") heard a minor variance application regarding the property municipally known as 25 Manhattan Drive (the "Subject Property"). The owner of the Subject Property (the "Applicant") sought relief from the former City of Scarborough, Wexford Community Zoning By-law No. 9511 and the City-wide Zoning By-law No. 569-2013 to permit the already expanded driveway in front of the existing dwelling (the "Application"). In a report prepared for the Committee from the Director of Community Planning, Scarborough District dated December 3, 2018, Planning Staff recommended that the Application be refused (the "Report"). The Report indicated that the Application's requested variances for the driveway width are not consistent with the prevailing characteristics of the established neighbourhood. Additionally, the Report indicated that the magnitude of the requested variances does not meet the general intent and purpose of the Official Plan and Zoning By-law, are not minor and do not represent appropriate development of the land. The Committee approved the Application (the "Decision").
Scarborough Community Council recommends that: 1. City Council authorize the City Solicitor, along with appropriate City Staff, and outside consultants, as necessary, to attend the Toronto Local Appeal Body in order to oppose the Application and related variances requested in Committee Application No. A0317/18SC respecting 25 Manhattan Drive. 2. City Council authorize the City Solicitor to attempt to negotiate a resolution regarding the Application, and that the City Solicitor be authorized to resolve the matter on behalf of the City in her discretion after consulting with the Ward Councillor and with the Director of Community Planning, Scarborough District.
