The City entered into an Agreement of Purchase and Sale with the owners of the property known as 76 Coral Gable Drive on December 12, 2019 with a condition, imposed by the City, that the City would have to successfully fundraise one-half of the purchase price within one year of the City's execution of the Agreement of Purchase and Sale, failing which the Agreement of Purchase and Sale would terminate. The Agreement also provides that the City may waive this condition. The condition will expire on December 11, 2020 and the fundraising goal has not been met. Consequently, it is urgent that City Council review the current campaign progress and make a determination with respect to the purchase before December 11, 2020.
City Council on November 25 and 26, 2020, adopted the following: 1. City Council authorize the Executive Director, Corporate Real Estate Management to waive the condition precedent contained in the Agreement of Purchase and Sale between the City and the owners of 76 Coral Gable Drive to allow the purchase transaction to proceed and City Council authorize the Director, Toronto Office of Partnerships to continue with its fundraising toward the development of the parkette. 2. City Council authorize the Executive Director, Corporate Real Estate Management to complete the contemplated transaction set out in the Agreement of Purchase and Sale between the City and the owners of 76 Coral Gable Drive on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms as they consider reasonable. 3. City Council amend the Approved 2020 Parks, Forestry and Recreation Capital Budget and 2021-2029 Capital Plan to create a new capital sub-project called "76 Coral Gable Drive Acquisition" in the Parkland Acquisition project as outlined in Confidential Attachment 1 to the report (November 18, 2020) from the Executive Director, Corporate Real Estate Management, including all fees and disbursements, to be funded from donations received and the Parkland Acquisition West District Local Land Acquisition Reserve Fund (XR2202). 4. City Council authorize the public release of Confidential Attachment 1 to the report (November 18, 2020) from the Executive Director, Corporate Real Estate Management once the funding goal is reached. Confidential Attachment 1 to the report (November 18, 2020) from the Executive Director, Corporate Real Estate Management remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006 as it pertains to a proposed or pending acquisition or disposition of land. A mixed-use development consisting of a tower height of 21 storeys with a three storey podium is in the process of being constructed by Menkes Development Ltd. at the municipal addresses of 219-231 Dundas Street East. The subject site is located on the south side of Dundas Street East, east of George Street and west of Pembroke Street. As a condition of the Site Plan Agreement (Site Plan Application 18 145012 STE 27 SA), a northbound left-turn prohibition at all times is required at the driveway access at 219-231 Dundas Street East and the developer is required to advise the City in advance of the anticipated date of first occupancy of the project, so that the required By-law can be enacted. The expected occupancy of the project will be June 2021. The subject turn prohibition is required to improve operations and safety by prohibiting outbound left turns at all times onto Dundas Street East and requiring motorists exit this location with a right-turn movement. As the Toronto Transit Commission operates a transit service on Dundas Street East, City Council approval is required.

The applicant applied to the Committee of Adjustment (Application A0030/20SC, the "Application") to construct a new three-story single family residential dwelling. The Application requests variances with respect to lot coverage, building height, floor space index, permitted number of storeys and permitted area at or above the second storey. At its hearing on September 23, 2020, the Committee of Adjustment Scarborough Panel refused the Application. The Notice of Decision is attached.

An application has been submitted to the Alcohol and Gaming Commission of Ontario for a liquor licence at the premises at 221 Sorauren Avenue to operate under Ideal Coffee. This Motion requests that City Council advise the Alcohol and Gaming Commission of Ontario that this application for a liquor licence is not in the public interest unless certain conditions, addressing the concerns of the community, are attached to the licence. This establishment is located in close proximity to residential units. There are concerns that an establishment with a liquor licence can cause noise and disturbance to residents in the area. If conditions are put in place, these concerns may be mitigated. Under no circumstance should the establishment be granted a liquor sales license without conditions attached. This matter is considered urgent as the deadline for objections is December 1, 2020.

On Wednesday, November 4, 2020, the Toronto and East York Panel of the Committee of Adjustment (the "Committee") refused Application A0655/20TEY brought by the owner of 65 Langley Avenue (the "Applicant") for a minor variance in order to permit a parking space in the front yard to serve the existing three-storey detached dwelling. On November 23, 2020, the Applicant appealed the Committee of Adjustment's decision to the Toronto Local Appeal Body. 65 Langley Avenue was subject to a previous minor variance application, approved in part by the former Ontario Municipal Board in 2016. The previous minor variance application included a request for variances to permit a parking space in the front yard, which were not approved in the Ontario Municipal Board Decision. This Motion will authorize the City Solicitor to attend the Toronto Local Appeal Body in opposition to the Application, and to secure the necessary authorization and resources to support the City's position. This Motion is time sensitive and urgent as the Committee's decision has been appealed and the City Solicitor requires instructions to attend the hearing.

The City of Toronto has received a request from the restaurant, C'est What, for an outdoor patio space to be located at the property municipally known as 94 The Esplanade. C'est What is located at 67 Front Street East and would like to convert the southern half of the surface parking lot at 94 The Esplanade for a temporary outdoor patio space during the COVID-19 pandemic. The same landowner owns both properties. The temporary use by-law is proposed as a site-specific amendment to the City-wide harmonized Zoning By-law (569-2013) and also to the former City of Toronto By-law (438-86). The by-law is proposed to expire on May 25, 2021, after the conclusion of next year's Victoria Day long weekend. Further, a provincial Regulation under the Emergency Management and Civil Protection Act (EMCPA) amends S. 39 of the Planning Act by removing notice requirements and appeal rights to temporary use by-laws that authorize outdoor patios associated with eating establishments. The by-law would allow an outdoor patio, with restrictions, to be provided at 94 The Esplanade. Beverage service will be handled on-site and the food will be delivered to the table from the restaurant at 67 Front Street East, which is the building that is immediately adjacent to 94 The Esplanade, east of a public laneway that bisects the two properties.

City Council enact the Zoning By-law amendment for 67 Front Street East and 94 The Esplanade substantially in accordance with Attachment 2 to the report (November 16, 2020) from the Chief Planner and Executive Director, City Planning. 2. The HousingTO 2020-2030 Action Plan identifies the critical need to protect the existing supply of affordable rental housing across the City. This Motion seeks Council's approval to transfer $150,000 to the Shelter, Support and Housing Administration's Operating Budget, on a one time basis, to provide funding to St. Clare's Multifaith Housing Society, fully funded from Section 37 (Planning Act Reserve Fund) community benefits from the developments at 124 and 128 Pears Avenue, 275 Albany Avenue and 420 Dupont Street and 126-128 Hazelton Avenue within Ward 11. This funding will support modernization of kitchens in 10 existing affordable rental housing units at 138 Pears Avenue. This work will improve the quality of homes for existing and future residents. During the ongoing COVID-19 pandemic, the need for safe, affordable homes is even more acute to protect both individual and public health. This Motion is urgent as it will allow capacity of the building to increase, while improving the quality of life of the residents as quickly as possible.

City Council authorize the Executive Director, Housing Secretariat to provide $150,000 in funding, inclusive of Harmonized Sales Tax and disbursements, from the Capital Revolving Reserve Fund for Affordable Housing (XR1058) to St. Clare's Multifaith Housing Society, a non-profit housing operator, to support the modernization of 10 kitchens at 138 Pears Avenue in Ward 11, fully funded from the following development: a. 124 and 128 Pears Avenue, secured for public housing improvements in Ward 20 (now Ward 11), in the amount of $67,317 (Source Account XR3026-3700792); b. 275 Albany Avenue and 420 Dupont Street, secured for the provision of new affordable housing in Ward 20 (now Ward 11), in the amount of $80,583 (Source Account XR3026-3701049); and c. 126-128 Hazelton Avenue, secured for capital improvements for new or existing affordable housing, in the amount of $2,100 (Source Account XR3026-3700969). 2. At its meeting on December 4, 5 and 13, 2018, City Council provided authority for the City to enter into an agreement with the Toronto District School Board for the redevelopment of the Davisville Junior Public School with additional grant funding from the City in the amount of $1.528 million, for a total commitment of $8.335 million. To date, $6.807 million has been transferred to the Toronto District School Board for the design and construction of an additional third floor and underground garage and the balance of $1.528 million is required to be disbursed by December 31, 2020. This Motion requests authority from Council to amend the Approved 2020 Operating Budget for Non-Program (NP2161) in the amount of $1.528 million gross, $0 net, fully funded by Section 37 community benefits obtained from four developments that have been received and are eligible for these purposes.

Dino Chiesa was appointed Chair of the CreateTO Board of Directors for a term ending December 31, 2021. Mr. Chiesa has recently been on a leave of absence from the Board. Ron Carinci, who has been Vice Chair of the CreateTO Board of Directors since February 15, 2019, has been Acting Chair in his absence. Effective November 24, 2020, Mr. Chiesa has returned from his leave, but has advised that he intends to stay on the Board only until City Council appoints a new Chair. This Motion is urgent as City Council should appoint a new Chair of the CreateTO Board as soon as possible to ensure the orderly succession of the new Chief Executive Officer, the process for which has been initiated by the Board.

On July 14, 2020, the Committee of Adjustment (the "Committee") refused a Consent to Sever and two Minor Variance applications brought by the owner of 186 Ellerslie Avenue for the following variances: side yard setback, rear deck setback, lot area, lot frontage, lot coverage, front yard setback, platform, maximum height for side exterior side walls, maximum building height and maximum finished first floor height. A copy of the Committee's decisions are attached. The Applications proposed to construct two new detached dwellings on undersized lots. In the report (May 22, 2020) from Community Planning, North York District, staff opposed the Applications and recommended its refusal. A copy of Planning's staff report is attached. Planning staff stated that the proposed lot frontage do not form the prevailing character of the lots found in the immediate context and thus fail to satisfy the general intent and purpose of the Official Plan and Zoning By-law. Planning staff also opined that the proposed side yard setbacks are not in keeping with the prevailing pattern of side yard setbacks within the neighbourhood and thus fail to satisfy the general intent of the Official Plan and Zoning By-law. Planning staff opined that the Applications do not confirm to the Official Plan, and the requested Consent to Sever application fails to satisfy the criteria under section 51(24) of the Planning Act and the requested Minor Variance applications do not meet the four tests under section 45(1) of the Planning Act. On August 14, 2020, the owner appealed the Committee's decision to refuse the Applications to the Toronto Local Appeal Body. The Toronto Local Appeal Body has issued a notice of hearing for this file and the City's deadline to elect to be a party is November 26, 2020.
