8-26 Jopling Avenue South - Zoning By-law Amendment Application - Final Report
This application proposes to amend the former City of Etobicoke Zoning Code and Site Specific Zoning By-law 1088-2002 for the properties located at 8-26 Jopling Avenue South to permit a mixed-use development consisting of two towers of 27 and 33 storeys connected by a 4 to 6-storey base. The proposed development contains 678 residential units and has a total gross floor area of 50,758 m2, which would result in a Floor Space Index of 11.3 times the area of the lands. The proposal includes 459 m2 of commercial space and 467 m2 of community space located on the ground floor and a 257 m2 of Privately Owned Publicly Accessible Space ("POPS") providing a mid-block connection at the south edge of the site between Jopling Avenue South and the Hydro Corridor. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). This report reviews and recommends approval of the application to amend the Zoning By-law. The proposal conforms with the Official Plan and Etobicoke Centre Secondary Plan and is generally consistent with the City's guidelines. The proposed development represents appropriate intensification within the Etobicoke Centre as it fits within the planned context of the area.
The Etobicoke York Community Council recommends that: 1. City Council amend the former City of Etobicoke Zoning Code and Site Specific Zoning By-law 1088-2002 for the lands at 8, 10, 12, 14, 16, 18, 22, 24 and 26 Jopling Avenue South substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 to the report (December 13, 2021) from the Director, Community Planning, Etobicoke York District. 2. City Council authorizes the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required. 3. Before introducing the necessary Bills to City Council for enactment, City Council require the owner to: a. Complete a peer review process of the submitted Electromagnetic Field Study, by a third party consultant, retained by the City of Toronto and at the owner's expense to the satisfaction of the Chief Planner and Executive Director, City Planning. If necessary, the proposed draft Zoning By-law Amendment be revised to address any mitigation measures arising from the accepted study; b. Submit a revised Functional Servicing Report, to the satisfaction of the Executive Director of Engineering and Construction Services, to determine the storm water runoff, sanitary flow and water supply demand resulting from this development and whether there is adequate capacity in the existing municipal infrastructure to accommodate the proposed development; c. Submit a revised Transportation Impact Study to address the unsignalized intersection analysis, passenger pick-up and drop-off management, and provision of vehicle manoeuvring diagrams to the satisfaction of the Manager, Transportation Services; d. Enter into the appropriate agreements with the City for the design and construction of any improvements to the municipal infrastructure, should it be determined that upgrades are required to the infrastructure to support this development, according to the accepted Functional Servicing Report and Traffic Impact Study accepted by the Executive Director of Engineering and Construction Services; and e. Provide space within the development for installation of maintenance access holes and sampling ports on the private side, as close to the property line as possible, for both the storm and sanitary service connections, in accordance with the Sewers By-law Chapters 681, to the satisfaction of the Executive Director of Engineering and Construction Services. 4. Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act to the satisfaction of the Chief Planner and Executive Director, City Planning, and the City Solicitor, as follows: a. Prior to the earlier of condominium registration or first residential use on site, the owner shall design, construct, finish and convey to the City, in an acceptable environmental condition, for nominal consideration and at no cost to the City, a minimum 467 m² Community Agency Space located on the ground floor adjacent to the POPS and subject to the following: 1. The Community Agency Space shall be delivered to the City in accordance with the City's Community Space Tenancy Policy and finished to Base Building Condition, with the terms and specifications to be secured in the Section 37 Agreement, all satisfactory to the Executive Director, Social Development, Finance and Administration, the Executive Director, Corporate Real Estate Management, the Chief Planner and Executive Director, City Planning and the City Solicitor; 2. Prior to the issuance of the first above grade building permit, the owner shall provide a letter of credit in the amount sufficient to guarantee 120% of the estimated cost of the design, construction and conveyance of the Community Agency Space complying with the specifications and requirements of the Section 37 Agreement, to the satisfaction of the Executive Director, Corporate Real Estate Management, the Executive Director, Social Development, Finance and Administration, the Chief Planner and Executive Director, City Planning and the City Solicitor; 3. Prior to conveyance of the Community Agency Space to the City, the owner shall provide a one-time cash contribution in the amount of $560,000.00 for future capital improvements to the Community Agency Space; 4. The financial contribution pursuant to Recommendation 4.a.3. above shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Building Construction Price Index for Toronto Census Metropolitan area, reported quarterly by Statistics Canada in Building Construction Price Indexes Table: 18-10-0135-10, or its successor, calculated from the date of execution of the Section 37 Agreement to the date of payment; and 5. Concurrent with or prior to, the conveyance of the Community Agency Space to the City, the owner and the City shall enter into, and register on title to the appropriate lands, an Easement and Cost Sharing Agreement for nominal consideration and at no cost to the City, that is in a form satisfactory to the City Solicitor; the Easement and Cost Sharing Agreement shall address and/or provide for the integrated support, use, operation, maintenance, repair, replacement and reconstruction of certain shared facilities, and the sharing of costs, in respect thereof, of portions of the subject lands to be owned by the City and the owner as they pertain to the Community Agency Space. b. Prior to issuance of the first above-grade building permit, the owner shall make a cash contribution to the City in the amount of one million, four hundred and forty thousand dollars ($1,440,000.00) by certified cheque payable to the Treasurer, City of Toronto, to be allocated at the discretion of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor, toward capital improvements for one or more of the following capital improvements within the Ward: 1. The capital improvements referred to in Recommendation 4.b. above include: a. Hydro corridor multi-use trail (Bloor-Kipling - Burnhamthorpe); b. Public art, streetscape improvements and enhanced pedestrian and cycling connections; c. Local parks; and d. Local not-for-profit childcare. 2. The cash contribution referred to in 4.b. above shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Building Construction Price Index for Toronto Census Metropolitan area, reported quarterly by Statistics Canada in Building Construction Price Indexes Table: 18-10-0135-10, or its successor, calculated from the date of execution of the Section 37 Agreement to the date of payment; and 3. In the event the financial contribution in Recommendation 4.b. above has not been used for the intended purposes within three years of the by-law coming into full force and effect, the contribution may be redirected for another purposes, at the discretion of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor, provided that the purposes are identified in the Official Plan and will benefit the community in the vicinity of the lands. c. The following matters are also recommended to be secured in the Section 37 Agreement as matters of legal convenience to support development: 1. Prior to the issuance of any above grade building permit, the owner must design and construct all improvements as required in the Functional Servicing Report accepted by and to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services. 2. The owner shall, at its own expense, design, construct and thereafter maintain the Privately-Owned Publicly-Accessible Space ("POPS") area having a minimum area of 257 square metres along the south of the property, with the specific location, configuration and design to be determined and secured in the context of site plan approval to the satisfaction of the Chief Planner and Executive Director, City Planning. 3. Prior to the issuance of any above-grade building permit, the owner shall prepare all documents and convey, on terms set out in the Section 37 Agreement, an access easement in favour of the City for public use of the POPS, all to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor. 4. Prior to the earlier of first residential or non-residential use occupancy and first condominium registration of all or any portion of a building, the owner shall complete construction of the respective POPS to the satisfaction of the Chief Planner and Executive Director, City Planning, or such later date in the sole discretion of and on terms satisfactory to the Chief Planner and Executive Director, City Planning. 5. The owner shall, at its own expense, address the following matters in any application for site plan approval for the development, which shall be determined and secured in a site plan agreement with the City, as applicable, all to the satisfaction of the Chief Planner and Executive Director, City Planning: a. Implementation of any required electromagnetic field mitigation measures or other recommendations, as detailed in the Electromagnetic Field (EMF) Management Plan dated June 10, 2020, prepared by Intrinsik Corp, as may be amended through a peer review process undertaken at the expense of the owner to the satisfaction of the Chief Planner and Executive Director, City Planning; b. Implementation of the wind control measures identified in the Pedestrian Level Wind Study, dated June 10, 2020, prepared by Gradient Wind, the addendum to this study dated June 11, 2021, and any future addendum, to the satisfaction of the Chief Planner and Executive Director, City Planning; c. In the event that car-share spaces, as defined in the Zoning By-law Amendment, are to be provided, a car-share provider shall be secured to the satisfaction of the General Manager, Transportation Services; d. Construction of the City sidewalk to City standards along the Jopling Avenue South frontage, to the satisfaction of the General Manager, Transportation Services; e. Provision of on-site dog-relief facilities, with the location, nature and size of the facilities to be determined through the site plan approval process to the satisfaction of the Chief Planner and Executive Director, City Planning; f. Incorporation of signage to identify the proposed POPS to be located along the south edge of the site; and g. Construction and maintenance of the development of the site in accordance with Tier 1, Toronto Green Standard, or higher where appropriate, consistent with the performance standards of Toronto Green Standards applicable at the time of the site plan application for each building on the site. 6. The owner shall satisfy applicable signage requirements of the Toronto District School Board and the Toronto Catholic District School Board and shall insert warning clauses in purchase and sale/tenancy agreements as required in connection with student accommodation. 7. The owner shall provide notification to NAV Canada of the pending commencement of construction a minimum of 10 days prior to the start of the construction.

Picture Mount Dennis Planning Framework Study - Consultant's Final Report
This report provides an overview of the study process to date and the next steps required to implement the Picture Mount Dennis Study. The report provides the retained consultant, Perkins&Will's, findings and recommendations for the Picture Mount Dennis Study. On March 10, 2016, City Council adopted a motion (EY12.30) to request the Chief Planner and Executive Director, City Planning to undertake a review of the current planning framework for the Mount Dennis area, including: built form, density, height, and public realm, of the properties on Weston Road between Ray Avenue and Humber Boulevard; consult with the community, including landowners and other stakeholder groups, together with the Ward Councillor, to understand the community's concerns and to develop a vision for future development in the study area; and to report back on the findings of the review and to provide recommendations for changes, if necessary, to the planning framework for the study area. Mount Dennis is set to become one of the most transit connected neighbourhoods in Toronto. When the Eglinton Crosstown LRT opens in 2022, Mount Dennis will be the western terminus station and a key interconnection point between the subway and commuter rail systems, providing access to the Kitchener GO Line and UP Express. In anticipation of this connectivity and resultant transit oriented development interest, the Picture Mount Dennis Planning Framework creates a comprehensive vision for the future based on the input of area residents, businesses, local services and non-profit organizations and Indigenous partners. It also builds upon significant work that has been completed in the study area over the last 10 years. The study area includes lands designated Mixed Use Areas, Neighbourhoods and Apartment Neighbourhoods in the Official Plan. Although the study area includes lands designated Employment Areas and Institutional Areas, it does not contemplate or propose changes to those land uses. The study was a collaborative effort from various City Divisions including: City Planning, Transportation Services, Toronto Water and Public Health. City Planning retained Perkins&Will as the planning consultant to undertake the Picture Mount Dennis Planning Framework Study. The study was awarded through a competitive Request for Proposal process to a multidisciplinary consulting team led by Perkins&Will that includes sub-consultants Nelson Nygaard, Canadian Urban Institute, Cambium Indigenous Professional Services, Centre for Connected Communities, GM Blue Plan Engineering, LGL Limited Environmental Research Associates, Common Bond Collective, and Timmins Martelle Heritage Consultants Inc. The consultant's report contains study findings and recommendations for an updated planning framework to accommodate and manage growth in the area. Perkins&Will's Picture Mount Dennis Planning Framework report recommends that the City should consider a set of Frameworks and Healthy and Inclusive Community Strategies which outline several actions to implement the study recommendations, such as: - Amend the Official Plan to: implement the recommended changes to the Official Plan land use map specifically for properties along Weston Road and the rail corridor in close proximity to the new higher-order transit stations; implement the land use policies resulting from the study; include maximum building heights expressed in number of storeys for each character area based on the recommendations of the study and delineate Mount Dennis as a Protected Major Transit Station Area (PMTSA). - Draft a Secondary Plan for Mount Dennis to establish a comprehensive planning framework for the area and provide a new policy direction for Mount Dennis to support a transit oriented, complete community, including direction to: - Provide for diverse housing types; - Encourage active uses at grade and fine grain retail along Weston Road; - Provide provisions for future parkland dedication and Privately Owned Publicly Accessible Spaces; - Provide connected cycling network strategy; - Use the Black Creek Triangle as a demonstration project for the implementation of the Green Streets Technical Guidelines in the development of a new street network; - Consider heritage potential properties identified in the study for inclusion on the City's Heritage Register; - Initiate a Historic Context Statement about workers' housing and public housing as part of the Toronto Heritage Survey or commemoration and interpretation strategies should they be demolished; - Identify opportunities for public art and community event spaces, implement low impact development/green streets infrastructure; - Explore opportunities to improve older apartment towers through the City's Tower Renewal program and continue monitoring; and - Maintain and enhance existing community facilities and explore options for additional community services and facilities needs as develop. - Amend the Zoning By-law based on the recommendations of the report to: amend the zoning for lands within the PMTSA with a Neighbourhoods designation, establish maximum retail unit frontage length for new development on Weston Road; include maximum building heights, expressed in metres and number of storeys, for each character area; establish maximum retail sizes and amend zoning boundaries to resolve zoning inconsistencies. - Supplement applicable city-wide urban design guidelines, including updating and replacing sections of the 2010 Mid-Rise Performance Standards and the 2016 Addendum to the Mid-Rise Performance Standards with area specific urban design guidelines for the study area to reflect the recommendations of the study. - Continue to work with the community to address concerns raised throughout the Planning Framework process and consult on the recommendations with the Local Advisory Committee and with specific groups in Mount Dennis as necessary to provide input during the implementation process of the study. It is recommended that City staff be directed to bring forward a draft Official Plan Amendment, including a draft Secondary Plan, a draft Zoning By-law Amendment and draft Urban Design Guidelines for the Picture Mount Dennis Study area in the first quarter of 2023, giving consideration to the findings and recommendations contained in the Final Report on the Picture Mount Dennis Planning Framework Study prepared by Perkins&Will after consulting with the Local Advisory Committee and through other public consultations that may support this work. It is also recommended staff provide a Directions Report to Etobicoke York Community Council in June 2022 to provide an update on the progress of this work.
The Etobicoke York Community Council: 1. Directed staff to continue consultation with the Local Advisory Committee and to engage with the public and key stakeholders including equity-deserving groups within the local community, Indigenous partners, landowners, businesses and agencies, as necessary on the draft Official Plan Amendment, including the draft Secondary Plan, draft Zoning By-law Amendment and draft Urban Design Guidelines for the lands included in the Picture Mount Dennis Planning Framework Study, together with the Ward Councillor. 2. Directed that the draft Official Plan Amendments appended to Attachments 1 and 2 to the report (December 8, 2021) from the Director, Community Planning, Etobicoke York District related to the Protected Major Transit Station Area be endorsed as a basis for further public consultation. 3. Directed staff to bring forward a draft Official Plan Amendment, including a draft Secondary Plan, a draft Zoning By-law Amendment and draft Urban Design Guidelines for the Picture Mount Dennis Planning Framework Study area in the first quarter of 2023 after giving consideration to and refining the findings and recommendations contained in the Final Report on the Picture Mount Dennis Planning Framework Study prepared by Perkins&Will and after undertaking a fiscal impact analysis and further consulting with the Local Advisory Committee and any other public consultations that may support this work. 4. Heavy Vehicle Prohibition Exemption - Renforth Drive
As the Toronto Transit Commission (TTC) operates a transit service on Renforth Drive, City Council approval of this report is required. Metrolinx's contractor West End Connectors ("the Project Co.") is responsible for designing and building the tunnel section of the Eglinton Crosstown West Extension (ECWE) project. The Project Co. is currently preparing the tunnel boring machine (TBM) launch site for the TBM arrival in January 2022. The tunnel launch site is located in the northwest quadrant of Renforth Drive and Eglinton Avenue West. The TBM is expected to start excavation in Spring 2022 and complete in Fall 2024. The excavation is expected to generate multiple truck trips (17 truck trips per hour) over 12 hours per day. To minimize traffic impacts on the City road network, the Project Co. has identified a direct haul route to nearby Highway 401, which requires a temporary exemption of heavy truck prohibition currently in effect on Renforth Drive, between Highway 401 and Eglinton Avenue West. The proposed haul route provides the shortest connection between the launch site and Highway 401 and minimizes impacts on the local road network and adjacent communities during the tunnel excavation operations. Therefore, this report requests Council approval for a temporary exemption of the heavy vehicle prohibition on Renforth Drive, between Highway 401 and Eglinton Avenue West to facilitate efficient and less impactful hauling of the excavated material.

My office received a petition to implement permit parking on Outlook Avenue, between Rockcliffe Boulevard and Jane Street. This block has residents without any access to off-street parking and as a result require street parking to meet their parking needs. During the polling process, the number of required ballots was not met even though those who did vote, voted in favour of implementing the program. Subsection 925-4B, provides that: Where permit parking is not currently available and where a petition requesting permit parking signed by the residents of a minimum of 25 percent of the total number of residential premises having a residential address on the street or the flank of the street is submitted to the General Manager, a poll shall be conducted in accordance with Chapter 190, Polling and Notification, to determine if the residents wish to have permit parking on their road or area, as the case may be. In the event of a positive polling result, the General Manager shall report such result to the appropriate community council, which community council under delegated authority, shall be authorized to pass any necessary by-laws to implement permit parking on the road or area. In the event of a negative result, permit parking shall not be extended to the road or area, and no further permit parking poll shall be conducted for a period of two years I am seeking an exemption from the requirements of subsection 925-4B of City of Toronto Municipal Code Chapter 925, Permit Parking as the residents that did vote, were in favour of implementing the permit parking program.

1 Blue Goose Street Minor Variance Application
Under the Smart Growth for Our Communities Act, 2015 (Bill 73) which came into final effect on July 1, 2016, Subsections 45. (1.3) and 45.(1.4) of the Planning Act as amended prevent the submission of minor variance applications on properties subject to a privately-initiated zoning by-law amendment within two years of by-law enactment, unless the municipal council has otherwise "declared by resolution that such an application is permitted." Site Specific Zoning By-law 653-2020 was enacted for 1 Blue Goose Street by City Council at its meeting of July 29, 2020. By-laws 653-2020 implemented owner-initiated amendments to Chapters 304 and 340 of the Etobicoke Zoning Code to permit the retention and renovation of the existing Blue Goose Tavern and micro-brewery, while undertaking renovations to provide 18 studio apartments in the existing building. In addition, an infill development is proposed to the south and east of the existing building, where 12 new townhouse dwelling units are proposed to be constructed. As the proposal has been advancing through the review for of an application for site plan control approval, Toronto Buildings has identified three areas that the development does not comply with the approved site specific zoning. To address these issues and advance the development, an application for minor variance to the Committee of Adjustment is required. The required zoning relief is to recognize reduced setbacks for a first-storey rear deck and columns along the south and east lot lines, and to permit a reduced setback requirements from a rail corridor. Under the Planning Act as now amended, the owner will not be able to file for a minor variance application for zoning relief in this regard until July 29, 2022, further delaying site redevelopment. As the proposed development (including built form and the use of the land) is for the most part largely the same as that which City Council previously considered and approved, City Council's authorization for submission of a minor variance application at this time is warranted.
The Etobicoke York Community Council recommends that: 1. City Council, pursuant to subsection 45(1.4) of the Planning Act, permit the applicant's request to apply to the Committee of Adjustment for minor variances in regards to the property municipally known as 1 Blue Goose Street from Site Specific Zoning By-law 653-2020 prior to the second anniversary of the day on which the site specific by-law was amended, including, but not limited to, with respect to the zoning requirements regarding setbacks.
