Transportation Services recommends that the T-shaped public lane at the rear of 371 Bloor Street West and north of Washington Avenue, between Spadina Avenue and Huron Street, be permanently closed. The T-shaped lane is surrounded on all four sides by lands owned by the Governing Council of University of Toronto (the "Council"). The University of Toronto Schools (UTS) has extended its affiliation agreement with the Council, which allows the University of Toronto Schools to remain at 371 Bloor Street West for an additional 50 years and to improve their facilities. The UTS proposed project is a 140,000 to 150,000 square foot expansion and renovation to the east wing of 371 Bloor Street West, providing facilities for 600 students. The project will also provide a 700 seat auditorium, atrium and outdoor teaching space as well as a new double height gymnasium below grade under the University Open Space known as the Huron Washington Parkette. In addition, an existing heritage building will be renovated and the existing gym will be converted into a library and the swimming pool into a black box theatre. The facilities will be accessible to the public to make use of the theatres and gymnasium during off hours. The University of Toronto Schools proposes the auditorium to build on a portion of the public lane.

This application proposes to redevelop the site at 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street with a 17-storey mixed-use building containing retail uses at grade and residential uses above. The building will have a height of 58 meters, including the mechanical penthouse, and the fronts of the existing heritage building at 663-665 King Street West, along King Street West, Bathurst Street and Stewart Street, will be retained. The application also proposes to demolish the four-storey building at 58-60 Stewart Street containing seven rental dwelling units and replace all of the existing rental units within the new proposed building. On August 21, 2017, the applicant appealed the Zoning By-law Amendment application to the Local Planning Appeal Tribunal, citing City Council's failure to make a decision within the time prescribed by the Planning Act. At its May 23, 2018 meeting, City Council adopted a Request for Direction report opposing the project in its current form, but also including a recommendation that City Planning continue discussions with the applicant to resolve outstanding issues with the proposal. Since that time, City Planning staff and the applicant have met a number of times to discuss revisions to the proposal. On November 19, 2018, the applicant submitted a proposed settlement of its Zoning By-law appeal as outlined in the revised plans, dated November 19, 2018, and attached as Attachments 1-5 to this report. This is a revision from the original proposal submitted on December 22, 2016, for a 19-storey mixed-use building with a height of 62 metres (67 metres including mechanical penthouse). The revised proposal is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2017). The revised proposal also conforms with the policies of the Official Plan, the King-Spadina Secondary Plan, the Council-adopted King-Spadina Urban Design Guidelines (2006), King-Spadina Secondary Plan Review, the King-Spadina Heritage Conservation District and the Downtown Official Plan Amendment 406. This report reviews and recommends that City Council authorize the City Solicitor and appropriate City staff, to attend before the Local Planning Appeal Tribunal in support of a settlement of the Zoning By-law Amendment appeal for the site, subject to conditions as outlined in the Recommendations section of this report. An application for Rental Housing Demolition under Section 111 of the City of Toronto Act (Chapter 667 of the Toronto Municipal Code) has been filed to permit the demolition of seven existing rental units at 58-60 Stewart Street. This report recommends that City Council defer making a decision on the Rental Housing Demolition Application to demolish the seven existing rental dwelling units at 58-60 Stewart Street until a decision has been issued by the Tribunal regarding the Zoning By-law Amendment appeal. The report also recommends that a Tribunal order not be issued until such time as the form of any implementing By-laws is satisfactory to the Chief Planner and the City Solicitor and until a Section 37 Agreement and a Section 111 Agreement with the City has been executed and registered to the satisfaction of the City.
The Toronto and East York Community Council recommends that: 1. City Council authorize the City Solicitor and appropriate City staff to attend before the Local Planning Appeal Tribunal (LPAT) respecting the Zoning By-law Amendment appeal for 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street in support of revisions made to the proposed development as described in the Issue Background section and appended as Attachments 1-5 to the report (December 14, 2018) from the Director, Community Planning, Toronto and East York District. 2. City Council authorize the City Solicitor and the Director, Community Planning, Toronto and East York District to prepare and present a settlement to the Local Planning Appeal Tribunal, based on the following: a. A maximum height of 58 metres, not including the other usual permitted projections such as elevator overrun, exit stairs, parapets, vents, stacks, and window washing equipment to the satisfaction of the Chief Planner and Executive Director, City Planning; b. A total combined gross floor area of 21,850 square metres; and c. In situ retention of the entire north, west and south walls of the existing Banknote Building, which will be integrated with new construction, in accordance with the Heritage Impact Assessment prepared by ERA Architects Inc., dated November 21, 2018. 3. City Council direct the City Solicitor to request the Local Planning Appeal Tribunal to withhold its final Order until such time as: a. The final form of the Zoning By-law amendment is to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor, including securing the replacement rental units, rents, and tenant relocation and assistance plans and any other related rental matters for the rental dwelling units at 58-60 Stewart Street, and are in conformity with Section 3.2.1.6 of the Official Plan; b. The owner has entered into and registered a Section 37 Agreement with the City incorporating such replacement rental units, rents, tenant assistance and other related rental matters and other Section 37 matters, all to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor; c. The owner has secured an off-site parkland dedication pursuant to Section 42 of the Planning Act to the satisfaction of the General Manager, Parks, Forestry and Recreation; d. The owner has secured off-site office replacement through the submission of a development approval application for another property within the vicinity of the site at 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street. Any proopsed development at the off-site location must demonstrate the following characteristics, all to the satisfaction of the Chief Planner and Executive Director, City Planning: - contextually appropriate height, built form, density and massing, including any building setbacks and stepbacks; - heritage conservation, if applicable; - appropriate use(s); and, - ability to accommodate a minimum of 1,955 square metres of office space to fulfill the office replacement requirements for the subject site, without creating an office space deficiency at the off-site location. e. The owner provides revised plans, drawings and studies to reflect the outstanding requirements outlined in the Engineering and Construction Services memorandum of February 22, 2017, all to the satisfaction of the Chief Planner and Executive Director, City Planning and the Chief Engineer and Executive Director, Engineering and Construction Services; f. The owner agrees to pay for and construct any improvements to the municipal infrastructure in connection with the site servicing report, as accepted by the Chief Engineer and Executive Director, Engineering and Construction Services, should it be determined that upgrades to such infrastructure are required to support this development; g. The owner has entered into a Heritage Easement Agreement with the City for the property at 663-665 King Street West substantially in accordance with plans and drawings prepared by Diamond Schmitt Architects, submitted with the Heritage Impact Assessment prepared by ERA Architects Inc., dated November 21, 2018 or otherwise revised in accordance with a settlement offer or Local Planning Appeal Tribunal Order, subject to and in accordance with the approved Conservation Plan required in Recommendation 3.h. below, all to the satisfaction of the Senior Manager, Heritage Preservation Services including execution of such agreement to the satisfaction of the City Solicitor; h. The owner has provided a detailed Conservation Plan prepared by a qualified heritage consultant that is substantially in accordance with the conservation strategy set out in the Heritage Impact Assessment for 663 King Street West, ERA Architects Inc., dated November 21, 2018 or otherwise a conservation strategy revised in accordance with a settlement offer or Local Planning Appeal Tribunal Order, all to the satisfaction of the Senior Manager, Heritage Preservation Services; i. The owner has provided for the withdrawal of the appeal of the King Spadina Heritage Conservation District plan which was approved by City Council stating its intent to designate the area, including the properties which are subject to this proposal, under Part V of the Ontario Heritage Act; and j. City Council has dealt with the Rental Housing Demolition application No. 16 270246 STE 20 RH under Chapter 667 of the Toronto Municipal Code pursuant to Section 111 of the City of Toronto Act, 2006 to demolish the seven existing rental dwelling units at 58-60 Stewart Street. 4. City Council defer making a decision on Rental Housing Demolition application No. 16 270246 STE 20 RH under Chapter 667 of the Toronto Municipal Code pursuant to Section 111 of the City of Toronto Act, 2006 to demolish the seven existing rental dwelling units at 58-60 Stewart Street, and instruct staff to report on the Rental Housing Demolition application to Toronto and East York Community Council at such time as a Local Planning Appeal Tribunal decision has been issued regarding the Zoning By-law Amendment appeal for the lands at 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street. 5. City Council require the owner to register on the properties at 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street one or more agreements with the City pursuant to Section 37 of the Planning Act to the satisfaction of the City Solicitor, the Chief Planner and Executive Director, City Planning and the Senior Manager, Heritage Preservation Services with such facilities, services and matters to be set forth in the related site specific Zoning By-law Amendments giving rise to the proposed alterations. a. Before the Local Planning Appeal Tribunal issues any Order approving a site-specific by-law for the lands, the owner shall enter into and register an agreement pursuant to Section 37 of the Planning Act. The community benefits recommended to be secured in the Section 37 Agreement are as follows: i. The owner shall provide a minimum cash contribution of $250,000.00 toward new affordable housing within Ward 10; ii. The owner shall provide a minimum cash contribution of $250,000.00 toward capital repairs for Toronto Community Housing within Ward 10; iii. The owner shall provide a minimum cash contribution of $1,000,000.00 for the provision of public realm improvements in the vicinity of the subject site, along King Street West, Bathurst Street, and/or Stewart Street and/or around Victoria Memorial Square Park; iv. The owner shall provide a minimum cash contribution of $1,000,000.00 for the provision of community services and facilities in the vicinity of the site. v. The $2,500,000.00 cash contribution referred to in Recommendation 5.a.i - iv above is to be indexed upwardly in accordance with Statistics Canada's Construction Price Index for the Toronto Census Metropolitan Area, calculated from the date of the Local Planning Appeal Tribunal decision to the date of payment. All cash contributions will be payable prior to issuance of the first above-grade building permit. b. The following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support development, at the owner's expense: i. Securing the rental tenure for the seven rental replacement units for at least 20 years, rents for the two affordable and mid-range rental replacement units for at least 10 years, and an acceptable tenant relocation and assistance plan for all eligible tenants within the existing rental buildings located at 58-60 Stewart Street that are proposed to be demolished as part of the development application, and any other related rental matters, to the satisfaction of the Chief Planner and Executive Director, City Planning; ii. Provision of a minimum of ten percent (10%) of the residential units in the building in the form of three bedroom units and 25 percent (25%) as two bedroom units; iii. Submission, and thereafter implementation, of a construction management plan by the owner of 647, 663-665 King Street West, 69-73 Bathurst Street and 58-60 Stewart Street to address such matters as wind, noise, dust, street closures, parking and laneway uses and access. Such plan to be to the satisfaction of the Chief Planner and Executive Director, City Planning in consultation with the local Councillor and shall be completed prior to Site Plan approval; and, iv. Securing the preparation and thereafter the implementation of a Heritage Lighting Plan, a Signage Plan, an Interpretation Plan and requiring a letter of credit to secure all work included in the approved Conservation Plan and approved Interpretation Plan, including provision for upwards indexing, all to the satisfaction of the Senior Manager, Heritage Preservation Services.

22 Balliol Street - Zoning Amendment - Request for Direction
On February 23, 2016 a Zoning By-law Amendment application was submitted to permit a 38-storey (119.25 m not including the mechanical penthouse) mixed-use (retail and residential) rental building at 22 Balliol Street containing 425 dwelling units. On October 26, 2017, the applicant appealed to the Local Planning Appeal Tribunal (LPAT), citing Council's failure to make a decision on the application within the timeframe prescribed by the Planning Act. A pre-hearing conference occurred on November 6, 2018 at which the LPAT directed the parties, including the City, to submit all documentation related to the appeal on or before March 1, 2019. This report recommends that the City Solicitor together with Planning Staff and other appropriate Staff be directed to oppose the application in its current form at the LPAT. The proposed building does not fit within the character of the Apartment Neighbourhood along this section of Balliol Street in terms of height and density and does not transition appropriately away from the adjacent Mixed Use Area. It is not consistent with the Provincial Policy Statement (2014), does not conform with the Growth Plan for the Greater Golden Horseshoe (2017) and does not conform to the Official Plan. The proposed development does not adequately address the Midtown in Focus: Growth, Built Form and Infrastructure Review / Draft Built Form Principles.
The Toronto and East York Community Council recommends that: 1. City Council direct the City Solicitor and City Staff, as appropriate, to attend the Local Planning Appeal Tribunal to oppose the Zoning By-law Amendment application for 22 Balliol Street for the reasons set out in the report (December 17, 2018) from the Director, Community Planning, Toronto and East York District. 2. City Council authorize the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor, to secure services, facilities or matters pursuant to Section 37 of the Planning Act, should the proposal be approved in some form by the Local Planning Appeal Tribunal. 3. Non-Residential Demolition Application -3385 Dundas Street West
This demolition permit application is submitted to City Council for consideration and decision to grant or grant with conditions, approval of the demolition permit application, including the requirement for the owner to enter into a beautification agreement prior to the issuance of the demolition permit. This property is located in the former City of York and is subject to By-law 3102-95 of the former City of York. On February 5, 2018, Toronto Building received a demolition permit application to demolish the existing 1-storey building that was formerly a self serve car wash establishment. The purpose of this report is provide an update on the status of the working meetings and the Official Plan and Zoning By-law Amendment application for 900 and 980 Lansdowne Avenue and 30 Powerhouse Street in response to City Council direction from its July 23, 2018 meeting. At that meeting, City Council directed staff to continue to work with the applicant on the outstanding issues outlined in the Request for Directions Report from the Director, Community Planning, Etobicoke York District (EY 32.20) and to bring a report to the first Etobicoke York Community Council meeting of the next term. As the former Ward 17 is now part of Ward 9 in the Toronto and East York Community Council area, this report is being submitted to the Toronto and East York Community Council. Three meetings were held between the applicant and staff to discuss development options and to resolve technical issues, with the results to be incorporated into a revised formal re-submission. The revised proposal was submitted on November 29, 2018 and has been circulated for review. A community consultation meeting held in consultation with the Ward Councillor is anticipated in the first quarter of 2019 with a Final Report targeted for the second quarter of 2019.

Construction Staging Area Time Extension - Phase 1 - Adelaide Street West (19 Duncan Street)
As the Toronto Transit Commission (TTC) operates a transit service on Adelaide Street West, City Council approval of this report is required. Westbank Projects Corp. is constructing a 57-storey high mixed-use development at 219 and 223 Adelaide Street West and 19 Duncan Street. Construction of the development will be undertaken in several phases. This report deals with matters related to Phase 1 of construction only, which includes drilling, shoring and installation of façade retention steel structure. The sidewalk, bike lane and a portion of the eastbound curb lane on the south side of Adelaide Street West, are currently closed to accommodate construction staging operations for the development. City Council, at its meeting on October 2, 2017, approved the subject construction staging area from October 9, 2017 to April 9, 2018 and on April 24, 2018 the time extension of the subject construction staging area from April 30, 2018 to October 31, 2018. Transportation Services is requesting an approval to extend the duration of the subject construction staging area from January 30, 2019 to March 31, 2019 in order to complete the Phase 1 of construction.

City Council approve the continuation of the closure of the sidewalk, bike lane and eastbound curb lane on the south side of Adelaide Street West, between Duncan Street and 109.5 metres east, from January 30, 2019 to March 31, 2019. 2. City Council continue to direct the Acting Director, Traffic Management, Transportation Services, to add as a condition of permit, a requirement provision for a Traffic Control Person to be stationed at the intersection of Adelaide Street West and Duncan Street from January 30, 2019 to March 31, 2019. 3. Construction Staging Area - 281-289 Avenue Road
As the Toronto Transit Commission (TTC) operates a transit service on Avenue Road, City Council approval of this report is required. Davies Development Corp., is constructing a 9-storey residential development at 281-289 Avenue Road. The site is located on the east side of Avenue Road, between Cottingham Street and Macpherson Avenue. Transportation Services, is requesting approval to close the east sidewalk and a portion of the northbound curb lane on Avenue Road abutting the site for a period of 12 months to accommodate construction staging operations. The development is currently in progress, operating under a monthly Street Occupation Permit. With the subject construction staging area in place, Avenue Road, in the immediate vicinity of the site, will operate as two northbound lanes and three southbound lanes. Pedestrian movements on the east side of Avenue Road are maintained in a covered and protected walkway within the closed portion of the northbound lane. Pedestrian movements on the west side of Avenue Road are maintained on the existing sidewalk.
The Toronto and East York Community Council recommends that: 1. City Council reject the request for the closure of the east sidewalk and a 4.0 metre wide portion of the northbound curb lane on Avenue Road, between a point 40.2 metres south of Cottingham Street and a point 45.6 metres further south, from February 6, 2019 to February 6, 2020, and other recommendations associated with the proposed construction staging area at 281-289 Avenue Road.

Lash Group of Companies is constructing a 19-storey residential condominium building at 11 Lillian Street. The site is bounded by existing residential apartment buildings (65 Lillian Street) to the north, existing residential apartment buildings (148 Soudan Avenue) to the east, Soudan Avenue to the south and Lillian Street to the west. The development is currently in progress, operating under a monthly Street Occupation Permit. Transportation Services is requesting approval to continue the closure of the sidewalk and a portion of the southbound lane on the east side of Lillian Street to facilitate construction staging operations. Transportation Services is requesting approval to rescind the current parking prohibitions on the west sides of Fraser Avenue, Jefferson Avenue and Pardee Avenue to provide additional parking spaces around Lamport Stadium located at 1155 King Street West. City of Toronto's Shelter Support and Housing Administration (SSHA) reviewed city properties to provide 24-hour respite service and choose a location at 1155 King Street, the parking lot of Lamport Stadium. The new structure will occupy approximately 100 parking spaces at this location. Due to the high demand for parking, local residents, businesses and BIA want to make available alternative parking spaces around this location. Transportation Services, in discussion with the Toronto Parking Authority (TPA) and Shelter Support and Housing Administration is recommending additional pay-and-display parking spaces on the west sides of Fraser Avenue, Jefferson Avenue and Pardee Avenue. This proposal provides approximately 60 additional pay-and-display parking spaces. The proposed changes will not impact traffic operations as two-way traffic will be maintained.

This staff report is about a matter that Community Council has delegated authority to make a final decision, provided that it is not amended so that it varies with City policy or by-laws. A review of the traffic regulations on Dunfield Avenue and Lillian Street has determined a discrepancy between the on-street parking signage and the by-laws. In view of the above, it is recommended that installation of a stopping prohibition to be in effect at all times on the subject section of Dunfield Avenue and Lillian Street. The purpose of this report is to amend the existing southbound "No Right Turn, 4:00 p.m. to 6:00 p.m., Monday to Friday" regulation for southbound traffic and the existing southbound "No Left Turn, 7:00 a.m. to 9:00 a.m., Monday to Friday" for southbound traffic on Oakwood Avenue at Glenhurst Avenue, to exclude bicycles. Traffic Control Signals - Oakwood Avenue and Rosemount Avenue
The purpose of this report is to obtain approval to convert an existing pedestrian crossover (PXO) to traffic control signals on Oakwood Avenue at Rosemount Avenue. The installation of traffic control signals is technically justified and will enhance safety for pedestrians and motorists at the intersection of Oakwood Avenue and Rosemount Avenue. Based on the results of traffic control signals warrant, staff is recommending that the pedestrian crossover be replaced with traffic control signals. As the Toronto Transit Commission (TTC) operates bus service on Oakwood Avenue, City Council approval of this report is required. The TTC has been advised on the matter.
